I hope everybody had a nice, restful evening last night. Thank you for your patience with us. What I'm going to do is just I'm going to ask you those questions to make sure everybody was able to follow my instructions. Then I'll go over briefly our schedule for today and the schedule for tomorrow. All right? So the first, let me get to those questions. The first question is any member of the jury read, seen, or heard anything from any source that would affect your ability to be fair and impartial in this case?

Unverified identity
All right, good. Thank you for following those instructions. Now in regards to our schedule today, it's the anticipated, as you know in these cases, sometimes the best laid plans, but it's anticipated that we'll go this morning to about 11 o'clock. We'll take a break at 11:00, we'll come back. We'll take our afternoon break at one o'clock and we'll go into the afternoon probably somewhere between 3:00 and 4:00. All right? So that's today's schedule. Tomorrow's schedule, as best we can tell, we're going to do that view sometime probably in the morning. We're going to go to a couple of spots that have been mentioned in the testimony. Like I said, we'll go over a little bit more tomorrow, but you'll be getting out of... We're all going together in a bus with the court officers, the staff, the attorneys, myself, and we're going to get out of the bus. So that's just a word for the wise for footwear and to double check the weather. I'll go into that a little bit more probably by the end of the day, but just in case I forget, that's what we're going to do. And then the thought would be after that, we'll come back. We'll probably go again till sometime around in between 3:00 and 4:00. Okay? So that's the schedule. And then at the end of the day tomorrow, I'll address kind of where we are in regards to the timeline and the kind of overall schedule, just so you have some kind of idea where we are. All right. So with that, we're going to return to the case on trial. Commonwealth is presenting its evidence. Attorney Sprague.

Link to segment
Stephen Hall

Link to segment
Attorney Sprague
Unverified
18:37:00
Unverified identity
And did you do anything after that after giving Dawson to EMTs?
Link to segment
Stephen Hall
Unverified
18:45:00
Unverified identity
We ran back down into the basement to check to see if we could find other children.
Link to segment
Attorney Sprague
Unverified
18:50:00
Unverified identity
And what made you think there were other children to find?
Link to segment
Stephen Hall
Unverified
18:53:00

When Patrick Clancy said, "Well, I can't wake them up," instead of just the singular.
Link to segment

Link to segment
Attorney Sprague
Unverified
19:05:00

Link to segment
Attorney Sprague

Link to segment
Attorney Sprague
Unverified
20:36:00
Unverified identity
Sure. Sir, showing you what's been marked as Exhibit 95. Is this what you saw when you went down the stairs and went to the left, that first view?
Link to segment
Stephen Hall
Unverified
20:44:00
Unverified identity
Yes.
Link to segment
Attorney Sprague
Unverified
20:46:00
Unverified identity
And then showing you exhibit 96, is that a further view as you go into the room?
Link to segment
Stephen Hall
Unverified
20:52:00
Unverified identity
Yes.
Link to segment
Attorney Sprague
Unverified
20:56:00
Unverified identity
Now, when you went into that room, what did you see?
Link to segment
Stephen Hall
Unverified
21:00:00
Unverified identity
There were two children on the floor, motionless, and EMTs and paramedics were working on them.
Link to segment
Attorney Sprague
Unverified
21:10:00
Unverified identity
And did you later learn that those children were Cora Clancy and Callan Clancy?
Link to segment
Stephen Hall
Unverified
21:14:00
Unverified identity
Yes.
Link to segment
Attorney Sprague
Unverified
21:20:00
Unverified identity
Did you do anything to assist the medics at that time?
Link to segment
Stephen Hall
Unverified
21:24:00
Unverified identity
Excuse me. I asked if they needed any equipment.
Link to segment
Attorney Sprague
Unverified
21:28:00
Unverified identity
And did they ask you to get some equipment?
Link to segment
Stephen Hall
Unverified
21:30:00
Unverified identity
They asked me to grab a heart monitor.
Link to segment
Attorney Sprague
Unverified
21:33:00
Unverified identity
And did you do that?
Link to segment
Stephen Hall
Unverified
21:34:00
Unverified identity
I went and found the fire captain to ask where I could grab one. And he was pretty upset. So I ended up going back downstairs into the basement.
Link to segment
Attorney Sprague
Unverified
21:49:00
Unverified identity
At some point in time. Well, actually, if I could show you Exhibit 96 again and just ask if you could just point to us where you saw each child.
Link to segment
Stephen Hall
Unverified
22:11:00
Unverified identity
Okay. Here. And another was [inaudible 00:22:13] in that area.
Link to segment
Attorney Sprague
Unverified
22:14:00
Unverified identity
So for the record, the first area you pointed to was in between the blood stain and the black exercise band. Is that correct?
Link to segment
Stephen Hall
Unverified
22:23:00
Unverified identity
Correct.
Link to segment
Attorney Sprague
Unverified
22:24:00
Unverified identity
And then the second area was over in front of that small nightstand or some type of shelving unit?
Link to segment
Stephen Hall
Unverified
22:33:00
Unverified identity
Yes.
Link to segment
Attorney Sprague
Unverified
22:56:00
Unverified identity
At some point in time, did you go back outside?
Link to segment
Stephen Hall
Unverified
22:59:00
Unverified identity
Yes. They stated they need an officer with Lindsay Clancy.
Link to segment
Attorney Sprague

Unverified
23:21:00
Unverified identity

Link to segment

Link to segment
Stephen Hall
Unverified

Link to segment
Attorney Sprague
Unverified
23:58:00

And did you happen to look up?
Link to segment
Stephen Hall
Unverified
00:00
Unverified identity
Yes, I did.
Link to segment
Attorney Sprague
Unverified
01:00
Unverified identity
What did you see when you looked up?
Link to segment
Stephen Hall
Unverified
03:00
Unverified identity
There was an open window with blood marks around the window.
Link to segment
Attorney Sprague
Unverified
08:00

And did you also see blood marks on the shingles below that window?
Link to segment
Stephen Hall
Unverified
12:00
Unverified identity
I did.
Link to segment
Attorney Sprague
Unverified
16:00

Link to segment
Stephen Hall
Unverified
22:00
Unverified identity
Yes.
Link to segment
Attorney Sprague
Unverified
26:00

Link to segment
Stephen Hall
Unverified
02:04:00

02:19:00

And did you work for the Plymouth Police before that?
Link to segment
Brian Josephine
Unverified
05:00:00
Unverified identity
Yes, I did.
Link to segment
Attorney Sprague
Unverified
05:01:00
Unverified identity
And how long did you do that?
Link to segment
Brian Josephine
Unverified
05:03:00

Almost five years.
Link to segment
Attorney Sprague
Unverified
05:07:00

Link to segment

Link to segment

Back in January of 2023, what was your role with the Duxbury Police Department?
Link to segment
Brian Josephine
Unverified

Directing your attention specifically to January 24th, 2023, were you working an overtime shift that day?
Link to segment
Brian Josephine
Unverified
05:30:00
Unverified identity
Yes, I had picked up an overtime shift.
Link to segment
Attorney Sprague
Unverified
05:33:00
Unverified identity
And what shift was that?
Link to segment
Brian Josephine
Unverified
05:35:00

It was four to midnight, but I was scheduled to work till 8:00 PM.
Link to segment
Attorney Sprague
Unverified
05:39:00
Unverified identity
8:00 PM?
Link to segment
Brian Josephine
Unverified
05:41:00
Unverified identity
Yes, ma'am.
Link to segment
Attorney Sprague
Unverified
05:41:00

Okay. So you were scheduled to be there from 4:00 PM to 8:0 PM. Is that correct?
Link to segment
Brian Josephine

05:44:00
Unverified identity
That is correct.
Link to segment

And did you receive a dispatch at approximately 6:11 PM to go to 47 Summer Street in Duxbury?
Link to segment
Brian Josephine

06:04:00
Unverified identity
Yes, we did.
Link to segment
Attorney Sprague

06:06:00
Unverified identity
And when you say we, were you with a partner or were you alone?
Link to segment
Brian Josephine
Unverified
06:09:00
Unverified identity
No, I was by myself. We ride single in a cruiser there.
Link to segment
Attorney Sprague
Unverified

Unverified identity
Okay. So when you say we, do you mean that it was dispatched to all officers on patrol?
Link to segment
Brian Josephine
Unverified
06:16:00
Unverified identity
So usually with critical incidents calls, they put it over to dispatch and they'll say, Duxbury Police cars, start making your way to a certain address. That way everyone can get there as quickly as possible.
Link to segment
Attorney Sprague
Unverified
06:30:00

Dispatch was giving me description of the house. It took probably 15 seconds for me to identify the house. Parked in the street. I saw the number of the house and I made my way. I believe it was a mudroom that I went to.

Showing you Exhibit 33. When you say the mudroom that you went to, did you actually go inside the house or did you go to the door to the mudroom?

07:16:00

I went to the door to the mudroom to check if that was unlocked so I could make my way to the back of the house.

Unverified
07:22:00

And is that door depicted in this photograph?
Link to segment
Brian Josephine
Unverified
07:24:00
Unverified identity
Yes, it is.
Link to segment
Attorney Sprague
Unverified
07:25:00

And is it the door to the left of the garage?
Link to segment
Brian Josephine
Unverified
07:27:00
Unverified identity
Yes, it is.
Link to segment
Attorney Sprague
Unverified
07:31:00

And was the door locked or unlocked?
Link to segment
Brian Josephine
Unverified
07:32:00

It was locked at that time.
Link to segment
Attorney Sprague
Unverified
07:33:00

So what did you do next?
Link to segment
Brian Josephine
Unverified
07:35:00

I radioed dispatch just for confirmation of where that party we were trying to get to was located. They told me it was around back of the house, so I tried to make my way that way.
Link to segment
Attorney Sprague
Unverified
07:45:00

And when you went to the back of the house, how did you get there?
Link to segment
Brian Josephine
Unverified
07:49:00
Unverified identity
Well, referring back to the picture where the car was parked, I went to the right side. And I went around the garage. There was a fence and I went over the fence, I believe.
Link to segment
Attorney Sprague
Unverified
07:58:00

So showing you Exhibit 33, again, you went by these cars and around the house to the right?
Link to segment
Brian Josephine

Unverified identity
Yes, that's correct.
Link to segment
Attorney Sprague
Unverified
08:05:00

And showing you Exhibit 37, does that mean that you would've been coming around the house over here by the garage on the left and in the porch, the deck?

Brian Josephine
Unverified
08:24:00
Unverified identity
Yes, that's correct.
Link to segment

08:26:00

And when you came around there, what did you see?
Link to segment
Brian Josephine
Unverified
08:31:00

I made my way. I observed two parties, one lying in the ground and one standing over it. And I started to make my way towards the other end of the house, which is as towards this fence, as you guys can see in reference to that photo.
Link to segment
Attorney Sprague

08:53:00

Yes, that is correct.
Link to segment
Attorney Sprague

Yes, I did.
Link to segment

Unverified identity
Yes. He came from this side over here, the opposite direction in which I came.
Link to segment
Attorney Sprague
Unverified
09:16:00

So facing the house, he would've come around the left side of the house if you're facing the house?
Link to segment
Brian Josephine

09:20:00
Unverified identity
Yes. He parked on the street and came from this side, the opposite of where I came from.

09:26:00
Unverified identity
Okay. And do you recall what Patrick Clancy was doing when you first saw him?
Link to segment
Brian Josephine
Unverified
09:35:00
Unverified identity
‍ He was standing over Lindsay at that point. It appeared that he was trying to communicate with her. I observed him with a cell phone. It was kind of down by his side, so I don't know if they were talking or what, but it was probably a split second, and then he turned to my location, saw me because I was illuminating the yard with my flashlight, and then that's when me and him crossed paths.
Link to segment
Attorney Sprague

10:01:00

Unverified identity
Yes, I believe it was in his left hand.
Link to segment

Did you feel the need to put pressure on those wounds immediately?
Link to segment
Brian Josephine
Unverified
11:33:00

No. We also carry medical equipment such as tourniquet, gauze, stuff like that. And I believe due to the circumstances that I didn't need to utilize those tools.
Link to segment
Shanan Buckingham
Unverified
11:44:00

And the tourniquet that you carry, is that in case someone has some type of cut where an artery has been damaged or cut?
Link to segment
Brian Josephine
Unverified
11:54:00
Unverified identity
Yes, it is.
Link to segment
Shanan Buckingham
Unverified
11:56:00

Brian Josephine
Unverified
12:04:00
Unverified identity
Yes, we are.
Link to segment
Shanan Buckingham
Unverified
12:05:00

Link to segment
Brian Josephine
Unverified
12:06:00
Unverified identity
I did not, no.
Link to segment
Shanan Buckingham
Unverified
12:15:00
Unverified identity
And based on your training in first aid and as a police officer, as a first responder, did those wounds appear life-threatening?
Link to segment
Brian Josephine
Unverified
12:22:00
Unverified identity
No, they did not.
Link to segment
Shanan Buckingham
Unverified
12:24:00
Unverified identity
Did other emergency personnel from the fire department begin to arrive?
Link to segment
Brian Josephine
Unverified
12:28:00
Unverified identity
Yes. So I would say I tried to talk to Ms. Clancy for probably 30 seconds to a minute. And at that point, coming from that opposite side of the house, I observed Duxbury Fire personnel show up. And our protocol is to kind of turn the medical over to them because they're more highly trained than we are.
Link to segment
Shanan Buckingham

12:49:00

Link to segment
Shanan Buckingham
Unverified
12:52:00

What do you hear?
Link to segment
Brian Josephine
Unverified
12:54:00
Unverified identity
Myself and Officer Hall were standing by that window and we just started hearing loud screams.
Link to segment
Shanan Buckingham
Unverified
13:02:00
Unverified identity
And what did you do when you heard those loud screams?
Link to segment
Brian Josephine
Unverified
13:07:00
Unverified identity
We immediately were trying to figure out where they were coming from. I'm not sure if dispatch or something came over the air and said something about the basement, but we both just started making our way back towards the deck part of the house.
Link to segment
Shanan Buckingham
Unverified
13:20:00

Did you go in through the sliding glass doors?
Link to segment

Yes. We went up the deck and through the sliding glass doors into the kitchen.
Link to segment
Shanan Buckingham
Unverified
13:26:00

And did you then head to the basement?
Link to segment
Brian Josephine
Unverified
13:28:00

Yes.
Link to segment
Shanan Buckingham
Unverified
13:29:00
Unverified identity
Okay. And could you hear any sounds coming from the basement as you entered the kitchen?
Link to segment
Brian Josephine
Unverified
13:35:00
Unverified identity
Yes, it was the exact screaming that I heard from the window.
Link to segment
Shanan Buckingham
Unverified
13:38:00
Unverified identity
Okay. And did you go down the stairs to the basement?
Link to segment
Brian Josephine
Unverified
13:44:00
Unverified identity
Yes, we did.
Link to segment
Shanan Buckingham
Unverified
13:45:00
Unverified identity
And did you see anything after you went down the stairs?
Link to segment
Brian Josephine
Unverified
13:48:00
Unverified identity
So we went down the stairs and there was a picture at the bottom of the stairs, I believe, of Lindsay and Patrick. And the basement splits off into two, a right and a left area. And the screams were coming from the right area. So that's where we directed our attention to first.
Link to segment
Shanan Buckingham
Unverified
14:04:00
Unverified identity
Okay. And did you see Patrick?
Link to segment
Brian Josephine
Unverified
14:07:00

Link to segment
Brian Josephine

Link to segment

Link to segment
Shanan Buckingham
Unverified
15:28:00

Link to segment
Shanan Buckingham

Link to segment
Shanan Buckingham

Link to segment
Shanan Buckingham
Unverified
16:00:00

Link to segment
Brian Josephine
Unverified
16:04:00
Unverified identity
Like I said, he was laying on his back. His head was tilted to the right-hand side. Looked at him kind of in the face area once we got closer and his face was white, gray. Lips were blue. Eyes were bloodshot. Looked like blood vessels were popped in his eyes.

The child.
Link to segment
Shanan Buckingham

17:13:00

And once you saw him there with these injuries, what did you do?
Link to segment
Brian Josephine
Unverified
17:22:00
Unverified identity
Based on my observations, I knew there wasn't really much I could do. So I picked the child up, went chest to chest. And as I did that, it was kind of like a mucus or a foam that leaked out of his mouth onto me. I grabbed him, went back towards the way. We came down into the basement and I headed up to the stairs where Sergeant Homestead was coming down the stairs and I started yelling to him to get out of the way. Went back up the stairs and then into the kitchen directly adjacent to the stairs is the front foyer hallway, and I went out that, out the main door into the driveway.

Link to segment

And when you went back at the house, did you go to the basement?
Link to segment
Brian Josephine
Unverified
18:39:00

Yes, I went back in that front door, back down to the basement, and this time I went to the left-hand side.
Link to segment
Shanan Buckingham
Unverified
18:45:00
Unverified identity
And when you went to the left-hand side of the basement, what did you see?
Link to segment
Brian Josephine
Unverified
18:49:00
Unverified identity
Pretty much directly in my sight was an older female laying on the ground and then in the corner there was a younger baby.
Link to segment
Shanan Buckingham
Unverified
19:00:00

And when you say an older female, you're referring to that she was older than Dawson?
Link to segment
Brian Josephine
Unverified
19:04:00
Unverified identity
That's correct.
Link to segment
Shanan Buckingham
Unverified
19:05:00

And did you later learn her name was Cora Clancy?
Link to segment
Brian Josephine
Unverified
19:08:00

I did.
Link to segment
Shanan Buckingham
Unverified
19:09:00

Shanan Buckingham
Unverified
19:13:00
Unverified identity
What did you do?
Link to segment
Brian Josephine
Unverified
19:15:00
Unverified identity
So when I got down to the basement, two fire personnel were already on scene. One was working on the baby and one was working on Cora. Communicated with them. We worked together and I took over doing chest compressions of Cora.
Link to segment
Shanan Buckingham
Unverified
19:33:00
Unverified identity
And were you able to see any injuries on Cora at that time?
Link to segment
Brian Josephine
Unverified
19:37:00
Unverified identity
Yes. She had kind of the same injuries that I explained with Dawson. The pale tint, bluish lips, bloodshot eyes, blood vessels popped. But this time she also had dried blood around her mouth.
Link to segment
Shanan Buckingham
Unverified
19:55:00
Unverified identity
And did you also see an area of blood near her on the floor?
Link to segment
Brian Josephine
Unverified
20:00:00
Unverified identity
Yes, there was a relatively large area of blood on the floor. Actually, when doing CPR on her [inaudible 00:44:08] and that blood seeped through my pants, so I ended up moving her a little off to the side so I could position myself better.
Link to segment

20:25:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
20:35:00
Unverified identity
Okay. While you were doing chest compressions on Cora, what was the firefighter doing?
Link to segment
Brian Josephine
Unverified
20:40:00
Unverified identity
The one that had previously been attending to Cora then went to the child that was in the corner.
Link to segment
Shanan Buckingham
Unverified
20:48:00
Unverified identity
And, eventually, was Cora put on a stretcher and brought out?
Link to segment
Brian Josephine
Unverified
20:57:00
Unverified identity
Yes, eventually. I think the baby was brought out first because I think they mentioned at some point they might've found a faint pulse or something like that, so they got him out first and then we were able to get Cora out.
Link to segment
Shanan Buckingham
Unverified
21:12:00
Unverified identity
So that entire time while you're in the basement, are you still giving chest compressions to Cora?
Link to segment
Brian Josephine
Unverified
21:17:00

Yes. Yeah. I mean, it felt like forever to the point where I think I radioed for assistance for another officer to come down.
Link to segment

Unverified
21:27:00
Unverified identity
And did others come down to assist?
Link to segment
Brian Josephine
Unverified
21:29:00

Yes. Officer Cahill came down to further assist where I continued with chest compressions and he used a bag valve mask to give rescue breaths.
Link to segment
Shanan Buckingham
Unverified
21:41:00

And a bag valve mask, is that something that goes over someone's face, a mask that's attached to a bag and you squeeze it to give air?
Link to segment

21:48:00
Unverified identity
Yes, it's an alternative breathing apparatus.
Link to segment

21:59:00

And do you encounter Patrick Clancy when you go upstairs?
Link to segment

He was still frantic, kind of in shock, still screaming and losing himself. And I think at that point, I don't know, one of us requested that we get an ambulance for him as well.

Shanan Buckingham

Paramedic has advanced lifesaving skills, intubation, and medicine we can use on the patients.

Link to segment
Shanan Buckingham

Shanan Buckingham
Unverified
01:33:00

Link to segment
PJ Hussey

Link to segment
Shanan Buckingham
Unverified

Link to segment
PJ Hussey

Link to segment

Is there a certain time that spans? Time of day?
Link to segment

Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:25:00

And your shift would end 8:00 o'clock in the morning on January 25th?
Link to segment
PJ Hussey
Unverified
02:28:00
Unverified identity
Correct.
Link to segment
Shanan Buckingham
Unverified
02:30:00
Unverified identity
Okay. And were you working in that capacity as a shift commander on the 24th?
Link to segment
PJ Hussey
Unverified
02:34:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:35:00
Unverified identity
Now, do you recall a call coming in shortly after 6:00 PM dispatching you to 47 Summer Street in Duxbury?
Link to segment
PJ Hussey
Unverified
02:42:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:43:00
Unverified identity
And did you respond to that scene?
Link to segment
PJ Hussey
Unverified
02:45:00
Unverified identity
We did.
Link to segment
Shanan Buckingham
Unverified
02:45:00
Unverified identity
And how many vehicles and personnel responded?
Link to segment
PJ Hussey
Unverified
02:50:00
Unverified identity
My car, the shift commander car, ambulance 1, and engine number 2.
Link to segment
Shanan Buckingham
Unverified
02:54:00
Unverified identity
And what was the personnel in each of those vehicles? Not names necessarily, but how many people?
Link to segment
PJ Hussey
Unverified
03:00:00
Unverified identity
Usually it's two in the ambulance, but because of the severity of the call when it first came in, we put three people in the ambulance, a driver plus two medics in the ambulance, and then two people, two firefighter medics in the engine from the other station.
Link to segment
Shanan Buckingham
Unverified
03:13:00
Unverified identity
So that would be six people in total?
Link to segment
PJ Hussey
Unverified
03:14:00
Unverified identity
Six total. Yeah.
Link to segment
Shanan Buckingham
Unverified
03:16:00
Unverified identity
And did you have anyone from the second station respond initially?
Link to segment
PJ Hussey
Unverified
03:22:00
Unverified identity
They all came. We all came at the same time. We all got dispatched at the same time.
Link to segment
Shanan Buckingham
Unverified
03:25:00
Unverified identity
So would that have been six people total from both stations or six people from the central station?
Link to segment
PJ Hussey
Unverified
03:30:00
Unverified identity
Six people total from both.
Link to segment
Shanan Buckingham
Unverified
03:35:00
Unverified identity
And when you arrived on scene, what did you see upon arrival?
Link to segment
PJ Hussey
Unverified
03:41:00
Unverified identity
There was a couple police cruisers that were there already, just had just beat us in. And then we had to go out back to where the patient was located.
Link to segment
Shanan Buckingham
Unverified
03:54:00
Unverified identity
And when you refer to the patient that was out back, was that Lindsay Clancy?
Link to segment
PJ Hussey
Unverified

Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified

Link to segment

Link to segment
Shanan Buckingham
Unverified

Unverified
04:05:00
Unverified identity
The paramedics were treating her.
Link to segment
Shanan Buckingham
Unverified
04:06:00
Unverified identity
Okay. And what were you doing?
Link to segment
PJ Hussey
Unverified
04:07:00
Unverified identity
Just supervising the call, just to make sure things are handled appropriately as a shift commander.
Link to segment
Shanan Buckingham
Unverified

Showing you what's been marked as Exhibit 37. Do you see the area where you were in the backyard that night on the screen?
Link to segment
PJ Hussey
Unverified
04:34:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
04:35:00
Unverified identity

Link to segment
PJ Hussey
Unverified
04:40:00
Unverified identity
The patient was approximately right here. I was over here in this area here.
Link to segment
Shanan Buckingham
Unverified
04:45:00
Unverified identity
And let the record reflect, you pointed to the patient being to the right of the metal window well, and you were standing to the left of the window well. Is that correct?
Link to segment
PJ Hussey
Unverified
04:52:00
Unverified identity
Yeah, she was right below this window, so at some point she was right in this area.
Link to segment
Shanan Buckingham
Unverified
04:55:00
Unverified identity
Okay.
Link to segment
PJ Hussey
Unverified
04:55:00
Unverified identity
And I was just a little bit further over.
Link to segment
Shanan Buckingham
Unverified
04:58:00
Unverified identity
And when you said, "right below this window," you're pointing to the far right second story window?
Link to segment

Yep. Yep. Yep.

Link to segment

Unverified
05:11:00

I heard a scream.
Link to segment
Shanan Buckingham
Unverified
05:12:00

Scream? And when you heard the scream, could you tell where it was coming from?
Link to segment
PJ Hussey
Unverified
05:17:00
Unverified identity
It sounded like it was coming from the basement.
Link to segment
Shanan Buckingham
Unverified
05:19:00
Unverified identity
And did you look anywhere in particular?
Link to segment
PJ Hussey
Unverified
05:21:00
Unverified identity
Yeah, I was able to look through the basement window and able to see a male person downstairs.
Link to segment
Shanan Buckingham
Unverified
05:29:00
Unverified identity
And when you say the basement window, are you referring to that first metal window well?
Link to segment
PJ Hussey
Unverified
05:33:00
Unverified identity
Yes. Yes.
Link to segment
Shanan Buckingham
Unverified
05:41:00
Unverified identity
That was in Exhibit 37. Just showing you again on the screen here, what's been marked as Exhibit 50. This window here on the right, does that fairly represent the window that you looked through and could see down into that basement office?
Link to segment
PJ Hussey
Unverified
06:01:00
Unverified identity
Yes. Yeah.
Link to segment
Shanan Buckingham
Unverified
06:05:00
Unverified identity
And was the light on in the basement office when you looked in?
Link to segment
PJ Hussey
Unverified
06:07:00
Unverified identity
A light was on, yes.
Link to segment
Shanan Buckingham
Unverified
06:09:00
Unverified identity
And what did you see when you looked in the window?
Link to segment
PJ Hussey
Unverified
06:13:00
Unverified identity
After I heard the scream, I saw a male, older male gentleman now knowing it was Patrick Clancy unwrapping something from a child's head.
Link to segment
Shanan Buckingham
Unverified
06:24:00
Unverified identity
And when you saw the male unwrapping something, can you demonstrate the motion that they were doing?
Link to segment
PJ Hussey
Unverified
06:30:00
Unverified identity
Yeah, the child was on the ground. The head was towards the window, so the head was towards the back of the house. And he was, picked the child up and he was in a circular motion taking something off the head, around the head, around the neck.
Link to segment
Shanan Buckingham
Unverified
06:46:00

And could you see the child's face?
Link to segment
PJ Hussey
Unverified
06:49:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
06:50:00
Unverified identity
And what observations did you make of the child's face?
Link to segment
PJ Hussey
Unverified
06:54:00
Unverified identity
The head was blue.
Link to segment
Shanan Buckingham
Unverified
06:56:00
Unverified identity
And did you later learn that child was Dawson Clancy?
Link to segment
PJ Hussey
Unverified
06:59:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
06:59:00
Unverified identity
At that point, what did you do?
Link to segment
PJ Hussey
Unverified
07:06:00
Unverified identity
Because of the severity of Ms. Clancy on the ground, and now we have another patient, I put a all call in, which is a recall of Duxbury personnel, all Duxbury personnel, if they're available, to come back to the town to help out for when I need help on the scene. And I also need help in the town to cover the town while I'm busy at this scene. And I also requested a Mutual Aid ambulance to respond to the scene.
Link to segment
Shanan Buckingham
Unverified
07:32:00
Unverified identity
Because at that time there was only one ambulance that was-
Link to segment
PJ Hussey
Unverified
07:35:00
Unverified identity
One ambulance for Ms. Clancy, yes. And then I called another. Seeing the next patient, I called another ambulance in.
Link to segment
Shanan Buckingham
Unverified
07:42:00
Unverified identity
Okay. And what is Mutual Aid?
Link to segment
PJ Hussey
Unverified
07:44:00
Unverified identity
Mutual Aid, it's a shared system that all the towns use, that if we get busy or busy with calls, we are able to call help in from surrounding towns to give us a hand, whether it be fire-related or medical-related.
Link to segment
Shanan Buckingham
Unverified
07:58:00
Unverified identity
Does Duxbury only have one ambulance?
Link to segment
PJ Hussey
Unverified
08:00:00
Unverified identity
We have three.
Link to segment
Shanan Buckingham
Unverified
08:01:00
Unverified identity
Three, but you only had one staff that night?
Link to segment
PJ Hussey
Unverified
08:03:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
08:03:00
Unverified identity
Okay. So you call in for an additional ambulance. At some point in time, do you learn that there are two other patients?
Link to segment
PJ Hussey
Unverified
08:09:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
08:09:00
Unverified identity
Cora Clancy and Callan Clancy?
Link to segment
PJ Hussey
Unverified
08:12:00
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
08:12:00
Unverified identity
At that point in time, do you have to do anything to call in more assistance?
Link to segment
PJ Hussey
Unverified
08:16:00
Unverified identity
Well, the recall for Duxbury personnel was already put in, so I called two more ambulances at that point.
Link to segment
Shanan Buckingham
Unverified
08:22:00
Unverified identity
And the scene that night, discovering another victim, another victim, was that a chaotic scene?
Link to segment
PJ Hussey
Unverified
08:33:00
Unverified identity
It turned very chaotic very quickly.
Link to segment
Shanan Buckingham
Unverified
08:35:00
Unverified identity
Okay. Yeah. And was it a situation where people would start treating a patient, but then have to move on to something else and someone would take over?
Link to segment
PJ Hussey
Unverified
08:46:00
Unverified identity
Sort of. So I had myself as a shift commander, I had an EMT with me, but there's also four paramedics. So the way it ended up working, all the initial paramedics were with Ms. Clancy in the beginning. And then when we found the other patients, we left a paramedic with Ms. Clancy, a paramedic with Dawson, and then two paramedics were with the two other kids in the other room.
Link to segment
Shanan Buckingham

Good morning.

Could you please tell the jurors your first and last name?
Link to segment
Loring Nudd
Unverified
10:42:00
Unverified identity
My first name is Loring, L-O-R-I-N-G. My last name is Nudd, N-U-D-D.

Ms. Buckingham

10:48:00

And do you have a nickname that you go by?
Link to segment
Loring Nudd
Unverified
10:49:00
Unverified identity
I do.
Link to segment
Ms. Buckingham
Unverified
10:50:00

What's that?
Link to segment
Loring Nudd
Unverified
10:50:00
Unverified identity
Everybody knows me as Chuck.
Link to segment
Ms. Buckingham
Unverified
10:52:00

Chuck. And do you work, sir?
Link to segment
Loring Nudd
Unverified
10:56:00
Unverified identity
I do.
Link to segment
Ms. Buckingham
Unverified
10:57:00
Unverified identity
What do you do for work?
Link to segment
Loring Nudd
Unverified
10:58:00
Unverified identity
So I'm a firefighter EMT with the Duxbury Fire Department. I was at that time. I am now retired.
Link to segment
Ms. Buckingham
Unverified
11:05:00
Unverified identity
Okay. So when did you retire?
Link to segment
Loring Nudd
Unverified
11:06:00
Unverified identity
So I retired a year ago.
Link to segment
Ms. Buckingham
Unverified
11:08:00
Unverified identity
Link to segment
Loring Nudd
Unverified
11:09:00
Unverified identity
Mm-hmm.
Link to segment
Ms. Buckingham
Unverified
11:10:00
Unverified identity
And so how long had you been working with Duxbury Fire before your retirement?
Link to segment
Loring Nudd
Unverified
11:15:00
Unverified identity
A little over 30 years.
Link to segment
Ms. Buckingham
Unverified
11:18:00
Unverified identity
30? And can you explain what your role was as a Duxbury firefighter?
Link to segment
Loring Nudd
Unverified
11:26:00
Unverified identity
I was an EMT, which 80% of our calls are probably that related. So I would assist a paramedic or I would drive the ambulance or whatever was necessary at the time. And then we also did fire suppression and we were all trained in that and went to the academy and all that.
Link to segment
Ms. Buckingham
Unverified
11:46:00
Unverified identity
Okay. And can you tell us what the difference is between an EMT and a paramedic?
Link to segment
Loring Nudd
Unverified
11:50:00
Unverified identity
So a paramedic requires another year or two of training and they're able to prescribe meds. I mean, not prescribe meds, excuse me, give meds that they have according to what they need to do. They can also read the monitor that shows rhythms in the heart and what have you.
Link to segment
Ms. Buckingham
Unverified
01:00:11
Unverified identity
Is it fair to say that as an EMT, you're trained in basic lifesaving techniques while a paramedic is advanced lifesaving techniques?
Link to segment
Loring Nudd
Unverified
01:00:19
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:00:20
Unverified identity
And so at Duxbury Fire Department, is it also fair to say that each and every firefighter has that dual role of either being an EMT, a paramedic, and a firefighter?
Link to segment
Loring Nudd
Unverified
01:00:32
Unverified identity
Yes. There might be one EMT, just a basic where most of them are the medics or the ... But we're all firefighters too.
Link to segment
Ms. Buckingham
Unverified
01:00:44
Unverified identity
Okay. And in the town of Duxbury, does the town itself have its own ambulances?
Link to segment
Loring Nudd
Unverified
01:00:50
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:00:51
Unverified identity
In addition to the fire engines?
Link to segment
Loring Nudd
Unverified
01:00:52
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:00:52
Unverified identity
And there's also ladder trucks, correct?
Link to segment
Loring Nudd
Unverified
01:00:54
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:00:56
Unverified identity
Now, when you were working as a Duxbury firefighter, what was the schedule? How did you work your shifts?
Link to segment
Loring Nudd
Unverified
01:01:03
Unverified identity
So we worked 24-hour shifts.
Link to segment
Ms. Buckingham
Unverified
01:01:05
Unverified identity
And then how many days on and how many days off?
Link to segment
Loring Nudd
Unverified
01:01:08
Unverified identity
So we'd have one day on, one day off, one day on, and five off.
Link to segment
Ms. Buckingham
Unverified
01:01:14
Unverified identity
And a 24-hour shift, when did it start and end?
Link to segment
Loring Nudd
Unverified
01:01:18
Unverified identity
It was 8:00 o'clock in the morning to 8:00 o'clock the next morning.
Link to segment
Ms. Buckingham
Unverified
01:01:21
Unverified identity
So if I direct your attention to January 24th of 2023, you were still working for the Duxbury Fire Department then, correct?
Link to segment
Loring Nudd
Unverified
01:01:28
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:01:29
Unverified identity
And were you on a 24-hour shift that day?
Link to segment
Loring Nudd
Unverified
01:01:31
Unverified identity
I was.
Link to segment
Ms. Buckingham
Unverified
01:01:33
Unverified identity
At some point during the day, were you given kind of what your assignment was for that shift?
Link to segment
Loring Nudd
Unverified
01:01:40
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:01:40
Unverified identity
What was your assignment?
Link to segment
Loring Nudd
Unverified
01:01:42
Unverified identity
So that day, I mean, we all kind of float around a little bit, but we had a newer member that had made progress. He was an EMT and then made it to paramedic. So I was kind of what they called the backup guy. So I would do whatever fill-in needed to be done and I would assist with them if necessary.
Link to segment
Ms. Buckingham
Unverified
01:02:03
Unverified identity
Okay. And so were you kind of assigned to the ambulance at the Central Station as that backup person?
Link to segment
Loring Nudd
Unverified
01:02:08
Unverified identity
I was.
Link to segment
Ms. Buckingham
Unverified
01:02:09
Unverified identity
And the person that you identified was kind of the newer employee, what was his name?
Link to segment
Loring Nudd
Unverified
01:02:15
Unverified identity
Paramedic Dougherty.
Link to segment
Ms. Buckingham
Unverified
01:02:16
Unverified identity
And that would be Daniel Dougherty?
Link to segment
Loring Nudd
Unverified
01:02:17
Unverified identity
Daniel Dougherty. Yeah.
Link to segment
Ms. Buckingham
Unverified
01:02:18
Unverified identity
And who was the other Duxbury firefighter that was assigned to the ambulance that shift?
Link to segment
Loring Nudd
Unverified
01:02:24
Unverified identity
It would've been paramedic Kevin Heath.
Link to segment
Ms. Buckingham
Unverified
01:02:26
Unverified identity
So at approximately 6:00 o'clock or just after 6:00 PM, were you advised of a dispatch to a residence in the town of Duxbury?
Link to segment
Loring Nudd
Unverified
01:02:39
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:02:39
Unverified identity
And where was that dispatch going to take you?
Link to segment
Loring Nudd
Unverified
01:02:42
Unverified identity
So it was going to take us to Summer Street.
Link to segment
Ms. Buckingham
Unverified
01:02:47
Unverified identity
And so you and Firefighter Heath and Firefighter Dougherty, you all get in the ambulance?
Link to segment
Loring Nudd
Unverified
01:02:55
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:02:56
Unverified identity
And do you go to 47 Summer Street?
Link to segment
Loring Nudd
Unverified
01:02:58
Unverified identity
We do.
Link to segment
Ms. Buckingham
Unverified
01:03:01
Unverified identity
In the ambulance, who was assigned as kind of the driver and the tech?
Link to segment
Loring Nudd
Unverified
01:03:05
Unverified identity
So at that time, because we had heard what kind of call, we had an idea of what call we were going to, the two medics sat up front and were able to converse while I sat in the back and again was that backup guy, more or less.
Link to segment
Ms. Buckingham
Unverified
01:03:20
Unverified identity
Okay. And as far as the nature of the call that you believed you were coming into, is it fair to say that the initial call had to deal with a female that had gone out the window, possibly a suicide?
Link to segment
Loring Nudd
Unverified
01:03:33
Unverified identity
Yeah. As I remember, it was a second-floor fall.
Link to segment
Ms. Buckingham
Unverified
01:03:37
Unverified identity
At the time that you were dispatched to that location, did you know that there was any pediatric patients or children involved?
Link to segment
Loring Nudd
Unverified
01:03:45
Unverified identity
No.
Link to segment
Ms. Buckingham
Unverified
01:03:45
Unverified identity
Okay. Now, approximately how long did it take to get from the station, Central Station to 47 Summer Street, if you recall?
Link to segment
Loring Nudd
Unverified
01:03:52
Unverified identity
I'm going to say four to five minutes.
Link to segment
Ms. Buckingham
Unverified
01:03:55
Unverified identity
And when you arrived on scene, were there already other emergency personnel on scene?
Link to segment
Loring Nudd
Unverified
01:03:59
Unverified identity
There were.
Link to segment
Ms. Buckingham
Unverified
01:04:00
Unverified identity
Were you the first ambulance on scene?
Link to segment
Loring Nudd
Unverified
01:04:02
Unverified identity
We were.
Link to segment
Ms. Buckingham
Unverified
01:04:03
Unverified identity
How about fire trucks? Were there any other fire trucks from Duxbury?
Link to segment
Loring Nudd
Unverified
01:04:06
Unverified identity
The firetruck, you could hear it in the background, but it wasn't there yet.
Link to segment
Ms. Buckingham
Unverified
01:04:09
Unverified identity
So is it fair to say that there were some Duxbury police cruisers that had arrived just ahead of you?
Link to segment
Loring Nudd
Unverified
01:04:14
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:04:15
Unverified identity
Where did you go with the ambulance when you got to that address of 47 Summer Street?
Link to segment
Loring Nudd
Unverified
01:04:21
Unverified identity
So as we were pulling up, I could hear the two guys up front say, "The cruisers are in the way of the driveway." So I said, " Okay, you guys take the call," meaning get out of the truck and get started, and I'll take care of the truck.
Link to segment
Ms. Buckingham
Unverified
01:04:37
Unverified identity
Okay. And so when you come to the address, are you able to at least pull into the driveway at some point?
Link to segment
Loring Nudd
Unverified
01:04:45
Unverified identity
Not at that point. Because I was in the back, I switched to the driver's seat. And at that time I saw an officer coming and he was getting ready to move the vehicle that was in our way so that I could back in.
Link to segment
Ms. Buckingham
Unverified
01:04:59
Unverified identity
And so Were you able to then back the vehicle, back the ambulance into the driveway?
Link to segment
Loring Nudd
Unverified
01:05:03
Unverified identity
I was.
Link to segment
Ms. Buckingham
Unverified
01:05:04
Unverified identity
And were there other vehicles that were not emergency personnel vehicles in the driveway?
Link to segment
Loring Nudd
Unverified
01:05:09
Unverified identity
There might have been some of their vehicles, but there might have been, but I don't really ... I had enough room to put my vehicle there and that's all that mattered.
Link to segment
Ms. Buckingham
Unverified
01:05:16
Unverified identity
Okay. So when you backed the ambulance in, Firefighter Heath and Firefighter Daugherty, what did they do?
Link to segment
Loring Nudd
Unverified
01:05:23
Unverified identity
They had already jumped out. They had already jumped out, grabbed the gear, and taken off for the back of the house.
Link to segment
Ms. Buckingham
Unverified
01:05:29
Unverified identity
Once you got the ambulance secured in the driveway, what did you do?
Link to segment
Loring Nudd
Unverified
01:05:33
Unverified identity
So assuming that they were going to need a stretcher, I started pulling a stretcher out of the back of the ambulance.
Link to segment
Ms. Buckingham
Unverified
01:05:39
Unverified identity
And again, you said you backed the ambulance in?
Link to segment
Loring Nudd
Unverified
01:05:41
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:05:42
Unverified identity
As you were pulling the stretcher out of the back of the ambulance, did you observe somebody coming from the house?
Link to segment
Loring Nudd
Unverified
01:05:48
Unverified identity
Yes. One of the-
Link to segment
Ms. Buckingham
Unverified
01:05:49
Unverified identity
What did you see?
Link to segment
Loring Nudd
Unverified
01:05:50
Unverified identity
One of the police officers was carrying a child.
Link to segment
Ms. Buckingham
Unverified
01:05:54
Unverified identity
And so what did you do when you saw him carrying the child out of the house? ‍
Link to segment
Loring Nudd
Unverified
01:05:57
Unverified identity
So at that point, the stretcher was almost out of the vehicle, and I said, "Over here." And he placed him on the stretcher.
Link to segment
Ms. Buckingham
Unverified
01:06:04
Unverified identity
Okay. Were you able to make observations of the child as he's being placed on the stretcher?
Link to segment
Loring Nudd
Unverified
01:06:11
Unverified identity
I was.
Link to segment
Ms. Buckingham
Unverified
01:06:12
Unverified identity
What did he look like?
Link to segment
Loring Nudd
Unverified
01:06:13
Unverified identity
So his face was blue, he had marks around his neck, and his body was pale.
Link to segment
Ms. Buckingham
Unverified
01:06:24
Unverified identity
And so once the officer ... Or first off, was the officer somebody you knew from Duxbury?
Link to segment
Loring Nudd
Unverified
01:06:29
Unverified identity
Correct. It was Officer Homestead.
Link to segment
Ms. Buckingham
Unverified
01:06:32
Unverified identity
Okay. And once the child was placed on the stretcher, what did you do after you made that initial observations of him?
Link to segment
Loring Nudd
Unverified
01:06:40
Unverified identity
So we rolled it right inside so he could start doing CPR.
Link to segment
Ms. Buckingham
Unverified
01:06:43
Unverified identity
Okay. Now, as an EMT, what is the first thing you generally do when you're observing a patient or assessing a patient?
Link to segment
Loring Nudd
Unverified
01:06:52
Unverified identity
So you always look for response and you go for airway.
Link to segment
Ms. Buckingham
Unverified
01:06:58
Unverified identity
Okay. And fair to say there's kind of what they call the ABCs?
Link to segment
Loring Nudd
Unverified
01:07:00
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:07:01
Unverified identity
Can you tell the jurors what that means?
Link to segment
Loring Nudd
Unverified
01:07:02
Unverified identity
So it's airway, breathing, circulation.
Link to segment
Ms. Buckingham
Unverified
01:07:05
Unverified identity
And in this circumstance, were you able to observe the child breathing on his own?
Link to segment
Loring Nudd
Unverified
01:07:12
Unverified identity
No.
Link to segment
Ms. Buckingham
Unverified
01:07:12
Unverified identity
How about, were you able to secure an airway for him?
Link to segment
Loring Nudd
Unverified
01:07:16
Unverified identity
Not at that time. We were still doing the preliminary.
Link to segment
Ms. Buckingham
Unverified
01:07:23
Unverified identity
And how about circulation or pulse or cardiac activity? Were you able to determine any of that upon your initial assessment of him?
Link to segment
Loring Nudd
Unverified
01:07:30
Unverified identity
At that point, no.
Link to segment
Ms. Buckingham
Unverified
01:07:33
Unverified identity
Now, after you are in the back of the ambulance, do other EMTs or other paramedics come and assist you with this child?
Link to segment
Loring Nudd
Unverified
01:07:40
Unverified identity
Yes. So when the patient was getting rolled in, I also yelled out to my captain, hoping that he was going to hear me, that I needed a medic in my truck because I needed him to know that there was someone in my truck. And I'm assuming someone heard me and they then directed a medic to my truck once one appeared.
Link to segment
Ms. Buckingham
Unverified
01:08:00
Unverified identity
Okay. And so the medic that came to the truck, was that Keith Nettie?
Link to segment
Loring Nudd
Unverified
01:08:07
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:08:08
Unverified identity
And that was not the original person who went to the scene with you in the ambulance, was it?
Link to segment
Loring Nudd
Unverified
01:08:14
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:08:14
Unverified identity
Okay. And what happened when you had the child in the back of the ambulance? What did you guys do to try to tend to him?
Link to segment
Loring Nudd
Unverified
01:08:27
Unverified identity
So we were doing CPR and then he wanted to check the monitor, so we got the monitor out.
Link to segment
Ms. Buckingham
Unverified
01:08:36
Unverified identity
Okay. And with the monitor, what was the monitor supposed to be looking for?
Link to segment
Loring Nudd
Unverified
01:08:45
Unverified identity
Heart rhythm.
Link to segment
Ms. Buckingham
Unverified
01:08:45
Unverified identity
Okay. And so do you have to kind of hook that up to the patient in order to assess whether there's any activity?
Link to segment
Loring Nudd
Unverified
01:08:52
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:08:53
Unverified identity
And those monitors that you have in your equipment, do they do anything more than just check for heart rate?
Link to segment
Loring Nudd
Unverified
01:09:02
Unverified identity
The paramedic can then look and see what kind of, not just a heart rate, but a rhythm. And then-
Link to segment
Ms. Buckingham
Unverified
01:09:07
Unverified identity
If there is not a rhythm, does that machine help you to do anything to try to restart somebody's heart?
Link to segment
Loring Nudd
Unverified
01:09:16
Unverified identity
With the rhythm that they gave us, they said, "We can disconnect it," because they were concerned they needed the monitor downstairs, too, or elsewhere.
Link to segment
Ms. Buckingham
Unverified
01:09:28
Unverified identity
And is it fair to say that at that point you are assisting the paramedic with their assessment and running-
Link to segment
Mr. Reddington
Unverified
01:09:34
Unverified identity
[inaudible 01:09:35]-
Link to segment
Ms. Buckingham

... that equipment and checking the monitor?
Link to segment
Judge
Unverified
01:09:42
Unverified identity
No, I'll allow it, but let's kind of move on.
Link to segment
Loring Nudd
Unverified
01:09:42
Unverified identity
I'm sorry.
Link to segment
Ms. Buckingham
Unverified
01:09:42
Unverified identity
That's okay.
Link to segment
Judge
Unverified
01:09:42
Unverified identity
[inaudible 01:09:44].
Link to segment
Ms. Buckingham
Unverified
01:09:43
Unverified identity
Are you assisting the paramedic at that point to-
Link to segment
Loring Nudd
Unverified
01:09:47
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:09:47
Unverified identity
... treat the child in the ambulance? At some point, do you leave the ambulance?
Link to segment
Loring Nudd
Unverified
01:09:51
Unverified identity
I do.
Link to segment
Ms. Buckingham
Unverified
01:09:52
Unverified identity
And where do you go after you leave the ambulance?
Link to segment
Loring Nudd
Unverified
01:09:55
Unverified identity
I bring the monitor down to the basement.
Link to segment
Ms. Buckingham
Unverified
01:09:58
Unverified identity
Are the other paramedics and the other responders still working on the child?
Link to segment
Loring Nudd
Unverified
01:10:02
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:10:02
Unverified identity
And-
Link to segment
Speaker 3
Unverified
01:10:00
Unverified identity
The responders still working on the child?
Link to segment
Speaker 5
Unverified
01:10:02
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:10:02
Unverified identity
And [inaudible 01:10:03]
Link to segment
Speaker 5
Unverified
01:10:18
Unverified identity
Because they said they needed equipment in the bay.
Link to segment
Speaker 3
Unverified
01:10:29
Unverified identity
[inaudible 01:10:23]. Were you able to make observations of those children?
Link to segment
Speaker 5
Unverified
01:10:38
Unverified identity
Not really. I mean, they weren't crying.
Link to segment
Speaker 3
Unverified
01:10:42
Unverified identity
Okay. Fair to say they were being treated by others?
Link to segment
Speaker 5
Unverified
01:10:45
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:10:46
Unverified identity
And so, once you dropped off that equipment, did you go back outside?
Link to segment
Speaker 5
Unverified
01:10:51
Unverified identity
I did.
Link to segment
Speaker 3
Unverified
01:10:51
Unverified identity
And what ultimately was your role at the end of this call? What were you asked to do?
Link to segment
Speaker 5
Unverified
01:10:55
Unverified identity
I was asked to drive.
Link to segment
Speaker 3
Unverified
01:10:58
Unverified identity
So, the ambulance that responded from Duxbury, that's ambulance number one?
Link to segment
Speaker 5
Unverified
01:11:04
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:11:04
Unverified identity
Ambulance one? Did you drive that ambulance to a hospital?
Link to segment
Speaker 5
Unverified
01:11:07
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:11:08
Unverified identity
Which hospital was that?
Link to segment
Speaker 5
Unverified
01:11:10
Unverified identity
I forget if it was with Jordan or the BI now, but it's the Plymouth Hospital.
Link to segment
Speaker 3
Unverified
01:11:13
Unverified identity
Here in Plymouth?
Link to segment
Speaker 5
Unverified
01:11:13
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:11:15
Unverified identity

Link to segment

Right now, I'm a captain shift commander.
Link to segment
Ms. Buckingham

Yes.

01:12:58

At Duxbury Fire, you all work 24-hour shifts?
Link to segment
Keith Nette
Unverified
01:13:02

Correct.
Link to segment
Ms. Buckingham

I was at home.
Link to segment

Okay. And so, what was the shift that you were working that week, if you remember?
Link to segment
Keith Nette
Unverified
01:13:19
Unverified identity
I believe I worked maybe two days prior. I don't really remember.
Link to segment
Ms. Buckingham
Unverified
01:13:23
Unverified identity
Okay. So, you were on a day off?
Link to segment
Keith Nette
Unverified
01:13:24
Unverified identity
Yes, correct.
Link to segment
Ms. Buckingham
Unverified
01:13:25
Unverified identity
And how was it that you ended up being involved in the call at 47 Summer Street on January 24th?
Link to segment
Keith Nette
Unverified
01:13:32
Unverified identity
We were recalled via a pager and text message that there was an incident going on and that we were to respond.
Link to segment
Ms. Buckingham
Unverified
01:13:39
Unverified identity
So, can you explain to us how that works?
Link to segment
Keith Nette
Unverified
01:13:43
Unverified identity
So, a tone goes off through dispatch that sends off a pager at our houses that alerts us. Then we also get text messages about the incident and then respond either to the station or to the scene, whichever they request.
Link to segment
Ms. Buckingham
Unverified
01:13:56
Unverified identity
As a Duxbury firefighter, are part of your responsibilities to respond to these recalls?
Link to segment
Keith Nette
Unverified
01:14:06
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:14:06
Unverified identity
Is it a voluntary thing?
Link to segment
Keith Nette
Unverified
01:14:08
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:14:08
Unverified identity
So, if you weren't disposed or unavailable when a call went out or tone went out, would you be expected to respond to the scene?
Link to segment
Keith Nette
Unverified
01:14:16
Unverified identity
No.
Link to segment
Ms. Buckingham
Unverified
01:14:16

But in this case, on January 24th, just after 6:00 PM, you heard that call go out, correct?
Link to segment
Keith Nette
Unverified
01:14:21
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:14:22
Unverified identity
And so, then what did you do when you heard the call?
Link to segment
Keith Nette
Unverified
01:14:24
Unverified identity
I drove to the scene in my personal truck.
Link to segment
Ms. Buckingham
Unverified
01:14:27
Unverified identity
When you got to the scene, what did you see?
Link to segment
Keith Nette
Unverified
01:14:29
Unverified identity
I saw police and fire vehicles. Then I walked up the driveway and walked into the back of the ambulance.
Link to segment
Ms. Buckingham
Unverified
01:14:37
Unverified identity
Now, when you arrived and saw police, that was Duxbury Police?
Link to segment
Keith Nette
Unverified
01:14:42
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:14:42
Unverified identity
And the fire personnel that was on scene, who was on scene, if you remember?
Link to segment
Keith Nette
Unverified
01:14:48
Unverified identity
I only saw two people on scene initially. That was Kevin Heath and Sergeant Homestead.
Link to segment
Ms. Buckingham
Unverified
01:14:55
Unverified identity
Okay. And Sergeant Homestead is a Duxbury officer?
Link to segment
Keith Nette
Unverified
01:14:57
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:14:58
Unverified identity
Now, was there a Duxbury ambulance in the driveway when you pulled up?
Link to segment
Keith Nette
Unverified
01:15:01
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:15:02
Unverified identity
And before even getting past that ambulance, were you asked to assist?
Link to segment
Keith Nette
Unverified
01:15:07
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:15:08
Unverified identity
What did you see when you came to the back of that ambulance?
Link to segment
Keith Nette
Unverified
01:15:11
Unverified identity
I saw an officer, Sergeant Homestead and Kevin Heath doing CPR on a child.
Link to segment
Ms. Buckingham
Unverified
01:15:23
Unverified identity
Had you seen how the child ended up in the ambulance or did you come after?
Link to segment
Keith Nette
Unverified
01:15:26
Unverified identity
I came after.
Link to segment
Ms. Buckingham
Unverified
01:15:27
Unverified identity
Okay. Did you then help take over with treating that child in the back of the ambulance?
Link to segment
Keith Nette
Unverified
01:15:33
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:15:35
Unverified identity
What was your initial observation of the patient? What did he look like?
Link to segment
Keith Nette
Unverified
01:15:40
Unverified identity
Blue, white, non-responsive, not breathing, no pulse.
Link to segment
Ms. Buckingham
Unverified
01:15:46
Unverified identity
And this particular patient, did you come to learn him to be the child named Dawson Clancy?
Link to segment
Keith Nette
Unverified
01:15:51
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:15:51
Unverified identity
And he was approximately three years old?
Link to segment
Keith Nette
Unverified
01:15:53
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:15:54
Unverified identity
What kind of treatment did you and the paramedic Heath offer to Dawson in the back of the ambulance? What did you do?
Link to segment
Keith Nette
Unverified
01:16:03
Unverified identity
We tried to start an IV. Then we also started an IO, which is kind of like an IV. Tried intubation, which is an advanced airway, medications and continued CPR.
Link to segment
Ms. Buckingham
Unverified
01:16:16
Unverified identity
So, an IV, that's just putting a needle into somebody and trying to pump fluids in medicine, correct?
Link to segment
Keith Nette
Unverified
01:16:25
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:16:25
Unverified identity
Tell us what an IO is.
Link to segment
Keith Nette
Unverified
01:16:27
Unverified identity
An IO is interosseous, which is basically into the bone marrow on the lower leg.
Link to segment
Ms. Buckingham
Unverified
01:16:32
Unverified identity
So, what do you do to try to enter an IO?
Link to segment
Keith Nette
Unverified
01:16:36
Unverified identity
Usually we have a drill, but we had a manual one instead.
Link to segment
Ms. Buckingham
Unverified
01:16:42
Unverified identity
So, what do you do with the manual drill to enter the IO?
Link to segment
Keith Nette
Unverified
01:16:46
Unverified identity
You just twist and then it goes into the bone.
Link to segment
Ms. Buckingham
Unverified
01:16:48
Unverified identity
And what bone do you attempt to do this in? And were you able to that IO into Dawson?
Link to segment
Keith Nette
Unverified
01:17:00
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:17:01
Unverified identity
What is the purpose of the IO versus the IV?
Link to segment
Keith Nette
Unverified
01:17:05
Unverified identity
If the patient has difficult access, which pediatrics do.
Link to segment
Ms. Buckingham
Unverified
01:17:10
Unverified identity
And in this circumstance, what kinds of medication were you trying to deliver through the IO to Dawson?
Link to segment
Keith Nette
Unverified
01:17:17
Unverified identity
Epinephrine.
Link to segment
Ms. Buckingham
Unverified
01:17:18
Unverified identity
What's the purpose of epinephrine?
Link to segment
Keith Nette
Unverified
01:17:20
Unverified identity
Basically just kind of helps to restart the heart.
Link to segment
Ms. Buckingham
Unverified
01:17:24
Unverified identity
And at this point, he had no heart activity?
Link to segment
Keith Nette
Unverified
01:17:27
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:17:28
Unverified identity
You also mentioned attempts to intubate. Can you tell us what that means?
Link to segment
Keith Nette
Unverified
01:17:32
Unverified identity
So, intubation is an advanced airway where you put a tube into the airway to secure it to deliver high flow oxygen.
Link to segment
Ms. Buckingham
Unverified
01:17:40
Unverified identity
Were you able to intubate Dawson?
Link to segment
Keith Nette
Unverified
01:17:43
Unverified identity
Yes, Kevin Heath did.
Link to segment
Ms. Buckingham
Unverified
01:17:45
Unverified identity
And what do you do when you enter the tool to intubate?
Link to segment
Keith Nette
Unverified
01:17:51
Unverified identity
You go into the mouth and you do a motion of pulling up to see the vocal cords so you can pass the tube through.
Link to segment
Ms. Buckingham
Unverified
01:17:59
Unverified identity
And what do you attach to the tube to try to increase the breath?
Link to segment
Keith Nette
Unverified
01:18:03
Unverified identity
Oxygen and a BVM, which is basically you're squeezing a bag.
Link to segment
Ms. Buckingham
Unverified
01:18:07
Unverified identity
So, BVM would stand for bag valve mask?
Link to segment
Keith Nette
Unverified
01:18:11
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:18:13
Unverified identity
While you were treating Dawson and doing the airway, intubating him, giving him the medicines, were you able to observe anything about the area of his neck?
Link to segment
Keith Nette
Unverified
01:18:26
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:18:27
Unverified identity
What did you observe about his neck?
Link to segment
Keith Nette
Unverified
01:18:30
Unverified identity
Dark red marks around his neck.
Link to segment
Ms. Buckingham
Unverified
01:18:37
Unverified identity
Now, all of this is happening while you were in the back of the ambulance with Firefighter Heath, correct?
Link to segment
Keith Nette
Unverified
01:18:45
Unverified identity
Correct.
Link to segment
Ms. Buckingham
Unverified
01:18:46
Unverified identity
And do you recall another Duxbury officer being present, Dan Doherty?
Link to segment
Keith Nette
Unverified
01:18:51
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:18:54
Unverified identity
Eventually, was that ambulance then sent to the local hospital?
Link to segment
Keith Nette
Unverified
01:18:59
Unverified identity
Yes.
Link to segment
Ms. Buckingham
Unverified
01:19:00
Unverified identity
Which hospital did you guys go to?
Link to segment
Keith Nette
Unverified
01:19:02
Unverified identity
EI Plymouth.
Link to segment
Ms. Buckingham
Unverified
01:19:02
Unverified identity
On the ride to the hospital, did you ever get a pulse for Dawson?
Link to segment
Keith Nette
Unverified
01:19:07
Unverified identity
No.
Link to segment
Ms. Buckingham
Unverified
01:19:08
Unverified identity
Were you ever able to resume breathing using that method with the bag valve mask?
Link to segment
Keith Nette
Unverified
01:19:13
Unverified identity
No.
Link to segment
Ms. Buckingham
Unverified
01:19:15
Unverified identity
The efforts to give him the medication, the epinephrine, did it ever do anything to start his heart?
Link to segment
Keith Nette
Unverified
01:19:21
Unverified identity
No.
Link to segment
Ms. Buckingham
Unverified
01:19:24
Unverified identity
When you arrived at the Beth Israel Hospital Emergency Department, tell us how you transferred the care of the patient.
Link to segment
Keith Nette
Unverified
01:19:32
Unverified identity
We wheeled the stretcher in. We went into the first room, which is trauma one and trauma two. We moved the patient over to their bed and then transferred care.
Link to segment
Ms. Buckingham
Unverified
01:19:40
Unverified identity
While you were at the emergency department at Beth Israel, did you see another child from that same home come in?
Link to segment
Keith Nette
Unverified
01:19:48
Unverified identity
I did.
Link to segment
Ms. Buckingham
Unverified
01:19:48
Unverified identity
And what department brought them in? What fire department?
Link to segment
Keith Nette
Unverified
01:19:51
Unverified identity
Marshfield.
Link to segment
Ms. Buckingham
Unverified
01:19:52
Unverified identity
Did you do anything to assist Marshfield when they came through the emergency department?
Link to segment
Keith Nette
Unverified
01:19:56
Unverified identity
I assisted in compressions when they were getting the child out of the ambulance.
Link to segment
Ms. Buckingham
Unverified
01:20:00
Unverified identity
And is that something that is ongoing during transportation when you're trying to transfer care to the emergency staff?
Link to segment
Keith Nette
Unverified
01:20:09
Unverified identity
Yes.
Link to segment
Ms. Buckingham

Link to segment

Link to segment
Ms. Buckingham

Link to segment

Link to segment

And yeah, just basically visually upset.
Link to segment
Ms. Buckingham
Unverified
01:20:35
Unverified identity
Did you do anything yourself to assist him when he was there?
Link to segment
Keith Nette
Unverified
01:20:38
Unverified identity
I assisted to get a chair in case he needed to sit down.
Link to segment
Ms. Buckingham
Unverified
01:20:41
Unverified identity
And was that before or after the children had passed, had been declared?
Link to segment
Keith Nette
Unverified
01:20:47
Unverified identity
I believe it was after.
Link to segment
Ms. Buckingham

And how are you employed, sir?
Link to segment

Unverified
01:22:10
Unverified identity
I'm a firefighter paramedic at the Duxbury Fire Department.
Link to segment
Speaker 3
Unverified
01:22:13
Unverified identity
And in what capacity are you a firefighter or paramedic? Do you have any supervisory roles?

No, I'm not a supervisor at the department.
Link to segment

Now at Station two in Duxbury, is it normal for just two of you to be on shifts at that station at any given time?
Link to segment
Patrick Dwyer
Unverified
01:23:46
Unverified identity
Yes, correct.
Link to segment
Speaker 3
Unverified
01:23:46
Unverified identity
And fair to say there are other firefighters and paramedics that are on staff at the central station, correct?
Link to segment
Patrick Dwyer
Unverified
01:23:52
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:23:54
Unverified identity
And in this dispatch, you at Station two on the engine were dispatched to 47 Summer Street, correct?
Link to segment
Patrick Dwyer
Unverified
01:24:01
Unverified identity
That's correct.
Link to segment
Speaker 3
Unverified
01:24:03
Unverified identity
When you received the dispatch, did you have any information that there had been children involved?
Link to segment
Patrick Dwyer
Unverified
01:24:10
Unverified identity
No, we did not.
Link to segment
Speaker 3
Unverified
01:24:11
Unverified identity
When you got to the scene, what did you see?
Link to segment
Patrick Dwyer
Unverified
01:24:15
Unverified identity
When we got there, it was dark out. We started walking towards the house and the other firefighters were there before us. Then we were directed to go to the basement.
Link to segment
Speaker 3
Unverified
01:24:31
Unverified identity
Before going to the basement, were you directed towards the outside of the house and then redirected to the basement?
Link to segment
Patrick Dwyer
Unverified
01:24:37
Unverified identity
We were walking towards the backyard, so I believe that's where the first person was located. So, we were kind of making our way back there.
Link to segment
Speaker 3
Unverified
01:24:45
Unverified identity
So, I'm just going to show you what's been previously marked as Exhibit number 34. Can you see it on the screen next to you?
Link to segment
Patrick Dwyer
Unverified
01:24:53
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:24:54
Unverified identity
And so, would this be 47 Summer Street?
Link to segment
Patrick Dwyer
Unverified
01:24:58
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:24:58
Unverified identity
And fair to say you were on your way to the backyard on the left side when you were redirected?
Link to segment
Patrick Dwyer
Unverified
01:25:04
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:25:05
Unverified identity
Did you ever make it into the backyard?
Link to segment
Patrick Dwyer
Unverified
01:25:08
Unverified identity
We went through the backyard to go into the residence.
Link to segment
Speaker 3
Unverified
01:25:13
Unverified identity
But you were directed to the basement, testified?
Link to segment
Patrick Dwyer
Unverified
01:25:15
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:25:20
Unverified identity
If you could take a look at that screen again. I'm going to show you what's been marked as Exhibit 38. Can you see over here sliding glass doors?
Link to segment
Patrick Dwyer
Unverified
01:25:30
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:25:30
Unverified identity
Is that where you entered the house?
Link to segment
Patrick Dwyer
Unverified
01:25:32
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:25:34
Unverified identity
You indicated that you also went to the basement, correct?
Link to segment
Patrick Dwyer
Unverified
01:25:37
Unverified identity
Correct.
Link to segment
Speaker 3
Unverified
01:25:39
Unverified identity
When you got into the house and went down into the basement, which side did you go to at the bottom of the stairs? The right or the left?
Link to segment
Patrick Dwyer
Unverified
01:25:46
Unverified identity
We went down to the left.
Link to segment
Speaker 3
Unverified
01:25:52
Unverified identity
What did you observe when you went down into the basement?
Link to segment
Patrick Dwyer
Unverified
01:25:57
Unverified identity
We saw two children on the ground and the father sitting on the couch next to them.
Link to segment
Speaker 3
Unverified
01:26:03
Unverified identity
Again, just going to show you what's been previously marked as Exhibit 95. Is that fair to be the left side basement?
Link to segment
Patrick Dwyer
Unverified
01:26:11
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:26:13
Unverified identity
And Exhibit 96, where did you see the father?
Link to segment
Patrick Dwyer
Unverified
01:26:24
Unverified identity
He was sitting on a couch or something in the area. Not sure exactly which one.
Link to segment
Speaker 3
Unverified
01:26:33
Unverified identity
Did you also observe the children on the floor?
Link to segment
Patrick Dwyer
Unverified
01:26:37
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:26:37
Unverified identity
How many children?
Link to segment
Patrick Dwyer
Unverified
01:26:39
Unverified identity
Two.
Link to segment
Speaker 3
Unverified
01:26:40
Unverified identity
What did you do when you observed the children?
Link to segment
Patrick Dwyer
Unverified
01:26:44
Unverified identity
We started CPR in cardiac arrest.
Link to segment
Speaker 3
Unverified
01:26:48
Unverified identity
Okay. And so, which child did you work on?
Link to segment
Patrick Dwyer
Unverified
01:26:51
Unverified identity
The five-year-old girl.
Link to segment
Speaker 3
Unverified
01:26:52
Unverified identity
Okay. Where was she located?
Link to segment
Patrick Dwyer
Unverified
01:26:55
Unverified identity
On the floor in that room.
Link to segment
Speaker 3
Unverified
01:26:57
Unverified identity
So, as far as looking at exhibit number 96, does that depict the general area where you saw the five-year-old child?
Link to segment
Patrick Dwyer
Unverified
01:27:04
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:27:05
Unverified identity
Where did you treat her? Where did you see her?
Link to segment
Patrick Dwyer
Unverified
01:27:09
Unverified identity
Right in that area. I can't remember exactly where it was.
Link to segment
Speaker 3
Unverified
01:27:11
Unverified identity
Okay. In this photograph of exhibit number 96, do you see a lot of equipment?
Link to segment
Patrick Dwyer
Unverified
01:27:19
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:27:19
Unverified identity
And I'm just going to show you Exhibit 101 too with some more equipment. Do you see all that equipment there?
Link to segment
Patrick Dwyer
Unverified
01:27:27
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:27:28
Unverified identity
Is that equipment that was used to treat the five-year-old child?
Link to segment
Patrick Dwyer
Unverified
01:27:34
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:27:35
Unverified identity
Did you learn her name to later be Cora Clancy?
Link to segment
Patrick Dwyer
Unverified
01:27:38
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:27:39
Unverified identity
While you were assisting or working with Cora, what was Jen Stratton doing, your partner?
Link to segment
Patrick Dwyer
Unverified
01:27:47
Unverified identity
She was with the other child.
Link to segment
Speaker 3
Unverified
01:27:50
Unverified identity
Do you recall where the other child was in relation to Cora?
Link to segment
Patrick Dwyer
Unverified
01:27:54
Unverified identity
They're kind of right next to each other.
Link to segment
Speaker 3
Unverified
01:28:02
Unverified identity
So, again, showing you exhibit number 96, if you look to the middle of the photograph, there's a red spot on the floor. Is that a fair place where Cora was?
Link to segment
Patrick Dwyer
Unverified
01:28:12
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:28:12
Unverified identity
And would the other child, the younger infant, was he closer to the couch or the bed area or was he in a different location in the basement?
Link to segment
Patrick Dwyer
Unverified
01:28:23
Unverified identity
Probably more towards this side, I would say, if I could remember.
Link to segment
Speaker 3
Unverified
01:28:28
Unverified identity
When you say this side, what do you see in the picture to depict where?
Link to segment
Patrick Dwyer
Unverified
01:28:32
Unverified identity
Probably closer to the cardiac monitor.
Link to segment
Speaker 3
Unverified
01:28:35
Unverified identity
Okay. And can you tell us which is the cardiac monitor? Is it here at the bottom?
Link to segment
Patrick Dwyer
Unverified
01:28:40
Unverified identity
Yes. A piece of equipment right there.
Link to segment
Speaker 3
Unverified
01:28:42
Unverified identity
And again, in exhibit 101, can you see the cardiac monitor a little better?
Link to segment
Patrick Dwyer
Unverified
01:28:50
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:28:50
Unverified identity
Where is it in this photograph?
Link to segment
Patrick Dwyer
Unverified
01:28:53
Unverified identity
Right there.
Link to segment
Speaker 3
Unverified
01:28:55
Unverified identity
Do you mind just getting up and pointing to it on the screen? So, we're talking about this black bag that is sort of off center of the photograph next to a blue bag. Is that fair to say?
Link to segment
Patrick Dwyer
Unverified
01:29:11
Unverified identity
Sorry, what was the question?
Link to segment
Speaker 3
Unverified
01:29:13
Unverified identity
I'm just trying to locate it on the picture for the record. So, you pointed to a black bag that's kind of off center in this photograph, correct?
Link to segment
Patrick Dwyer
Unverified
01:29:24
Unverified identity
This is a cardiac monitor.
Link to segment
Speaker 3
Unverified
01:29:25
Unverified identity
Okay. Thank you. When you started to treat Cora, what were your observations of her when you came upon her?
Link to segment
Patrick Dwyer
Unverified
01:29:41
Unverified identity
I noticed she kind of looked like she had some blood vessels around her eyes.
Link to segment
Speaker 3
Unverified
01:29:48
Unverified identity
Did you make any observations of the color of her skin?
Link to segment
Patrick Dwyer
Unverified
01:29:52
Unverified identity
It was kind of pale, bluish.
Link to segment
Speaker 3
Unverified
01:29:57
Unverified identity
When you approached the patient, what's the first thing that you do to assess them?
Link to segment
Patrick Dwyer
Unverified
01:30:02
Unverified identity
I check for breathing, check for a pulse.
Link to segment
Speaker 3
Unverified
01:30:05
Unverified identity
Did she have a pulse?
Link to segment
Patrick Dwyer
Unverified
01:30:07
Unverified identity
No.
Link to segment
Speaker 3
Unverified
01:30:07
Unverified identity
Was she breathing?
Link to segment
Patrick Dwyer
Unverified
01:30:08
Unverified identity
No.
Link to segment
Speaker 3
Unverified
01:30:09
Unverified identity
And when you're doing those things, are you able to make observations of the area around their face, like their nose and their mouth?
Link to segment
Patrick Dwyer
Unverified
01:30:17
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:30:18
Unverified identity
In this circumstance with Cora, did you notice anything around her mouth?
Link to segment
Patrick Dwyer
Unverified
01:30:23
Unverified identity
Around her mouth? Not that I can recall.
Link to segment
Speaker 3
Unverified
01:30:43
Unverified identity
When you were trying to assess her breathing, is there anything that you do to try to resuscitate somebody or get them to breathe?
Link to segment
Patrick Dwyer
Unverified
01:30:51
Unverified identity
Yes, we would use a bag valve mask to help them breathe.
Link to segment
Speaker 3
Unverified
01:30:56
Unverified identity
Did you do that for Cora?
Link to segment
Patrick Dwyer
Unverified
01:30:57
Unverified identity
Eventually when we got the equipment down there, yes.
Link to segment
Speaker 3
Unverified
01:31:02
Unverified identity
And were you able to use that device and get her to breathe on her own?
Link to segment
Patrick Dwyer
Unverified
01:31:08
Unverified identity
No.
Link to segment
Speaker 3
Unverified
01:31:08
Unverified identity
And while you're utilizing that bag valve mask, fair to say you're in close contact and making observations of the patient's face and mouth, correct?
Link to segment
Patrick Dwyer
Unverified
01:31:17
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:31:18
Unverified identity
And you indicated that you're not sure if you recalled seeing anything around her mouth?
Link to segment
Patrick Dwyer
Unverified
01:31:24
Unverified identity
Nothing particularly that I can think of.
Link to segment
Speaker 3
Unverified
01:31:27
Unverified identity
Okay. If I may approach. You may. I'm just going to show you page nine, and if you could read lines 17 through 19 to yourself. Does that refresh your memory?
Link to segment
Patrick Dwyer
Unverified
01:31:47
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:31:49
Unverified identity
What did you observe in or around Cora's mouth?
Link to segment
Patrick Dwyer
Unverified
01:31:52
Unverified identity
That she did have some blood in her mouth.
Link to segment
Speaker 3
Unverified
01:31:59
Unverified identity
Did eventually other emergency staff come down and help you with rendering aid on Cora?
Link to segment
Patrick Dwyer
Unverified
01:32:05
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:32:06
Unverified identity
And fair to say one of the things that you do is maintain compressions and CPR?
Link to segment
Patrick Dwyer
Unverified
01:32:11
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:32:12
Unverified identity
And can you do that by yourself or do you often have to have somebody help?
Link to segment
Patrick Dwyer
Unverified
01:32:15
Unverified identity
Oh, we usually have multiple people working.
Link to segment
Speaker 3
Unverified
01:32:18
Unverified identity
And in this circumstance with the treatment of Cora, other people came in and helped you with those things?
Link to segment
Patrick Dwyer
Unverified
01:32:23
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:32:23
Unverified identity
Were you eventually able to prepare her to leave the basement area?
Link to segment
Patrick Dwyer
Unverified
01:32:27
Unverified identity
Yes, once we got more first responders down there.
Link to segment
Speaker 3
Unverified
01:32:31
Unverified identity
And fair to say there was first responders from other departments that came and helped prepare to bring Cora out of the basement, correct?
Link to segment
Patrick Dwyer
Unverified
01:32:39
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:32:40
Unverified identity
Do you recall how she left the basement?
Link to segment
Patrick Dwyer
Unverified
01:32:43
Unverified identity
We took her out of the basement on a backboard up the bulkhead stairs.
Link to segment
Speaker 3
Unverified
01:32:49
Unverified identity
And the firefighters that were assisting putting her on the backboard, do you remember where they were from? What town?
Link to segment
Patrick Dwyer
Unverified
01:32:54
Unverified identity
Marshfield.
Link to segment
Speaker 3
Unverified
01:32:57
Unverified identity
When Cora was placed into an ambulance, do you remember what ambulance she was placed into?
Link to segment
Patrick Dwyer
Unverified
01:33:03
Unverified identity
Marshfield Ambulance.
Link to segment
Speaker 3
Unverified
01:33:04
Unverified identity
Did you continue to help assist them when she was put in the ambulance?
Link to segment
Patrick Dwyer
Unverified
01:33:07
Unverified identity
Yes, I went to the hospital with them.
Link to segment
Speaker 3
Unverified
01:33:10
Unverified identity
And do you remember who the firefighters were that were from Marshfield that were helping you?
Link to segment
Patrick Dwyer
Unverified
01:33:16
Unverified identity
Yes. Andrew Wilkins, Ryan Henry, and Carrie Cover.
Link to segment
Speaker 3
Unverified
01:33:23
Unverified identity
And fair to say Andrew and Ryan were in the back of the ambulance with you, correct?
Link to segment
Patrick Dwyer
Unverified
01:33:27
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:33:28
Unverified identity
And Carrie was driving?
Link to segment
Patrick Dwyer
Unverified
01:33:31
Unverified identity
I believe she was in the back also.
Link to segment
Speaker 3
Unverified
01:33:33
Unverified identity
Okay. At some point, somebody hopped in the front seat and drove?
Link to segment
Patrick Dwyer
Unverified
01:33:38
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:33:39
Unverified identity
And when you got to the hospital, which hospital did you transport to?
Link to segment
Patrick Dwyer
Unverified
01:33:43
Unverified identity
Beth Israel Plymouth.
Link to segment
Speaker 3
Unverified
01:33:45
Unverified identity
Were efforts continued to be made in that transport from Duxbury to Beth Israel and Plymouth?
Link to segment
Patrick Dwyer
Unverified
01:33:51
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:33:53
Unverified identity
While inside the ambulance, did you try to use one of those cardiac machines to shock or defibrillate Cora?
Link to segment
Patrick Dwyer
Unverified
01:34:02
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:34:03
Unverified identity
Was there any result for that?
Link to segment
Patrick Dwyer
Unverified
01:34:06
Unverified identity
We shocked once, but did not regain pulses.
Link to segment
Speaker 3
Unverified
01:34:10
Unverified identity
And when you got to the hospital, did you transfer care to the emergency staff at Beth Israel?
Link to segment
Patrick Dwyer
Unverified
01:34:16
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:34:17
Unverified identity
And did you do anything further on the care and treatment of Cora?
Link to segment
Patrick Dwyer
Unverified
01:34:21
Unverified identity
Not once we transferred care, no.
Link to segment
Speaker 3
Unverified
01:34:22
Unverified identity
I have nothing further.
Link to segment
Speaker 4
Unverified
01:34:22

Maybe four or five minutes.

And were you driving?

Jennifer Stratton
Unverified
01:37:40
Unverified identity
I was driving that night.

Speaker 3
Unverified
01:37:42
Unverified identity
What did you see when you arrived?
Link to segment
Jennifer Stratton
Unverified
01:37:44
Unverified identity
Pulled up to the address, saw our ambulance crew. They had arrived just before we did. They were starting to walk to the back of the house.
Link to segment
Speaker 3
Unverified
01:37:53
Unverified identity
And did you follow?
Link to segment
Jennifer Stratton
Unverified
01:37:55
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:37:55
Unverified identity
And what did you see in the backyard?
Link to segment
Jennifer Stratton
Unverified
01:37:57
Unverified identity
Came to the backyard, saw firefighter Dan Doherty kneeling next to a person. It was very dark. Ended up being Ms. Clancy. That was all we saw for a few seconds.

Unverified
01:38:10

And at that point, did you hear something?
Link to segment
Jennifer Stratton
Unverified
01:38:12
Unverified identity
We did. Heard a voice yelling for us to get inside of the house, that there was a kid hanging in the basement.
Link to segment
Speaker 3
Unverified
01:38:18
Unverified identity
And did you go into the house?
Link to segment
Jennifer Stratton
Unverified
01:38:19
Unverified identity
We did.
Link to segment
Speaker 3
Unverified
01:38:20

Through the slider doors in the rear.
Link to segment

Link to segment
Speaker 3
Unverified

Speaker 3

Jennifer Stratton
Unverified
01:38:37

Unverified
01:38:38
Unverified identity
And what did you see when you went left?
Link to segment
Jennifer Stratton
Unverified
01:38:41
Unverified identity
We took a left and we saw Callan and Cora face up on the ground.
Link to segment
Speaker 3
Unverified
01:38:47
Unverified identity
And when you saw them, what did you do?
Link to segment
Jennifer Stratton
Unverified
01:38:50

I immediately jumped on the radio to ask for two additional ambulances, that we needed more help. And Patrick ran to Cora and I went to Callan.

Speaker 3
Unverified
01:39:25

And where was Cora, to your memory?
Link to segment
Jennifer Stratton
Unverified
01:39:29

Cora was just to the left in this picture, and Callan was just to the right.
Link to segment

Link to segment
Speaker 3

Link to segment
Speaker 3

01:39:48

Link to segment
Speaker 3
Unverified
01:39:58

Link to segment

Yes.
Link to segment
Speaker 3
Unverified
01:40:05

Do you recall removing Callan's pajamas to treat him?
Link to segment
Jennifer Stratton
Unverified
01:40:11
Unverified identity
I did, yes.
Link to segment
Speaker 3
Unverified
01:40:17
Unverified identity
So, when you went over to Callan, you remove his clothing, what do you do after that?
Link to segment
Jennifer Stratton
Unverified
01:40:23
Unverified identity
I didn't remove his entire onesie right away, checked him for a pulse. He did not have one. Immediately started chest compressions on him.
Link to segment
Speaker 3
Unverified
01:40:32
Unverified identity
Now this is an eight-month-old baby, correct?
Link to segment
Jennifer Stratton
Unverified
01:40:35
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:40:35
Unverified identity
Is the way you do chest compressions for a baby different than other people, other ages?
Link to segment
Jennifer Stratton
Unverified
01:40:40
Unverified identity
Yes, because of the size, you have to scoop your arms around and you compress with your thumbs in the center.
Link to segment
Speaker 4
Unverified
01:40:44
Unverified identity
I'll allow it.
Link to segment
Speaker 3
Unverified
01:40:49
Unverified identity
So, you said you have to put your hands underneath on the back of the child and then use your thumbs to do compressions? Yes. And is that what you did for Callan?
Link to segment
Jennifer Stratton
Unverified
01:40:56
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:40:57
Unverified identity
And what did you do next?
Link to segment
Jennifer Stratton
Unverified
01:41:00
Unverified identity
Continued CPR on him until more help and hands started to arrive on scene. We had an off-duty firefighter, Tom Brandt, come in and he started to assist me. He took over compressions briefly while more help started to arrive.
Link to segment
Speaker 3
Unverified
01:41:15
Unverified identity
When Brandt took over chest compressions, what did you do?
Link to segment
Jennifer Stratton
Unverified
01:41:19
Unverified identity
At that point, someone had brought down a bag valve mask to help us deliver oxygen to the child, and we started delivering oxygen to the child.
Link to segment
Speaker 3
Unverified
01:41:29
Unverified identity
And at some point, did you remove the pajamas completely? Yes. And when you removed the pajamas completely, was that so someone could attempt to get IO access through the baby's legs? And was that successful?
Link to segment
Jennifer Stratton
Unverified
01:41:51
Unverified identity
That was not successful, no.
Link to segment
Speaker 3
Unverified
01:41:52
Unverified identity
Is that difficult to do with a child that age?
Link to segment
Jennifer Stratton
Unverified
01:41:56
Unverified identity
It's a little more difficult. It's a less frequent practice skill.
Link to segment
Speaker 3
Unverified
01:42:00
Unverified identity
Were multiple attempts made to get the IV access into the bone in Callan's leg?
Link to segment
Jennifer Stratton
Unverified
01:42:07
Unverified identity
I attempted once and another provider attempted a second time. I don't remember who that was.
Link to segment
Speaker 3
Unverified
01:42:13
Unverified identity
And neither attempt was successful? What did you do next? Sorry, I didn't get her answer. Oh, what was your answer?
Link to segment
Jennifer Stratton
Unverified
01:42:22
Unverified identity
For which part?
Link to segment
Speaker 3
Unverified
01:42:23
Unverified identity
I'm sorry. Was either attempt successful?
Link to segment
Jennifer Stratton
Unverified
01:42:25
Unverified identity
No. No.
Link to segment
Speaker 3
Unverified
01:42:26
Unverified identity
What did you do next?
Link to segment
Jennifer Stratton
Unverified
01:42:29
Unverified identity
Eventually, Kingston Fire arrived on scene to provide the ambulance for transport for Callan. I don't know how long we were in the basement for, but we did make the decision eventually it was time to get moving to the truck and start going to the hospital.
Link to segment
Speaker 3
Unverified
01:42:46
Unverified identity
While you were working on Callan, did you notice any injuries on him?
Link to segment
Jennifer Stratton
Unverified
01:42:49
Unverified identity
Yes. He had deep strangulation marks around the entire circumference of his neck.
Link to segment
Speaker 3
Unverified
01:42:54
Unverified identity
And throughout the entire time that you're in the basement, are chest compressions being done and you're trying to assist him with breathing?
Link to segment
Jennifer Stratton
Unverified
01:43:02
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:43:02
Unverified identity
Did he in the home ever gain a pulse or the ability to breathe?
Link to segment
Jennifer Stratton
Unverified
01:43:06
Unverified identity
No, he did not.
Link to segment
Speaker 3
Unverified
01:43:08
Unverified identity
Was he eventually taken to the ambulance?
Link to segment
Jennifer Stratton
Unverified
01:43:10
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:43:11
Unverified identity
And how was he removed from the basement and brought to the ambulance?
Link to segment
Jennifer Stratton
Unverified
01:43:14
Unverified identity
I scooped him up in my arms and carried him outside to the truck.
Link to segment
Speaker 3
Unverified
01:43:20
Unverified identity
And did you go with him in that transport to the hospital?
Link to segment
Jennifer Stratton
Unverified
01:43:23
Unverified identity
Yes.
Link to segment
Speaker 3
Unverified
01:43:24
Unverified identity
And at any point in time, did he regain the ability to breathe or heartbeat during that transport?
Link to segment
Jennifer Stratton
Unverified

Unverified identity
No, he did not.
Link to segment
Speaker 3

Unverified identity
Yes, we did.
Link to segment
Shanan Buckingham
Unverified
01:46:11

Between five and eight minutes.
Link to segment
Shanan Buckingham
Unverified
01:46:17

When you arrived, what did you see?
Link to segment
Robert Costanzo
Unverified
01:46:20

There were multiple pieces of equipment, other ambulances, police cars.
Link to segment
Shanan Buckingham
Unverified
01:46:26

When you arrived, were you directed to the backyard?
Link to segment
Robert Costanzo
Unverified
01:46:30

Yes.
Link to segment
Shanan Buckingham
Unverified
01:46:31
Unverified identity
And did you see a patient there in the backyard?
Link to segment
Robert Costanzo
Unverified
01:46:34
Unverified identity
Yes, we did.
Link to segment
Shanan Buckingham
Unverified
01:46:35
Unverified identity
And where was she located?
Link to segment
Robert Costanzo
Unverified
01:46:37
Unverified identity
She was on the ground with a Duxbury firefighter. She was already C-spined on a long board with a collar. She was unresponsive, but breathing on the ground.
Link to segment
Shanan Buckingham
Unverified
01:46:45
Unverified identity
And did you learn her name was Lindsay Clancy?
Link to segment
Robert Costanzo
Unverified
01:46:47
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
01:46:48
Unverified identity
And when you say she was already on a board with a C-spine, what type of equipment are we talking about? And if you could just explain to the jurors.
Link to segment
Robert Costanzo
Unverified
01:46:55
Unverified identity
So it's just a long flat board that we use to secure people when there's possible spinal injury. And she already had the collar on her neck. They had already started treatment prior to our arrival, so they had her all secured to the long backboard with the collar applied.
Link to segment
Shanan Buckingham
Unverified
01:47:13
Unverified identity
And did you notice anything about her wrists at that time?
Link to segment
Robert Costanzo
Unverified
01:47:16
Unverified identity
Yes. Her wrists were bandaged previously, assuming some kind of injury. There was no active bleeding or anything through the bandage, but her wrists were bandaged.
Link to segment
Shanan Buckingham
Unverified
01:47:27
Unverified identity
Was it white bandaging?
Link to segment
Robert Costanzo
Unverified
01:47:27
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
01:47:29
Unverified identity
And so nothing was seeping through to your eye? Did you see anything on her neck area?
Link to segment
Robert Costanzo
Unverified
01:47:35
Unverified identity
She had some superficial lacerations that we could see around the collar, but we don't typically remove equipment after it's already been placed. So I didn't investigate any further than that. There was no active bleeding that I could see, so we just left it alone.
Link to segment
Shanan Buckingham
Unverified
01:47:50
Unverified identity
So even with the collar, there was no blood flowing out of the collar or pooling around her or anything like that?
Link to segment
Robert Costanzo
Unverified
01:47:55
Unverified identity
Correct.
Link to segment
Shanan Buckingham
Unverified
01:47:58
Unverified identity
Was she breathing?

Shanan Buckingham

Link to segment
Robert Costanzo
Unverified
01:48:01
Unverified identity
No.
Link to segment
Shanan Buckingham
Unverified
01:48:02
Unverified identity
Was she making any noise at all?
Link to segment
Robert Costanzo
Unverified
01:48:04
Unverified identity
She was moaning and groaning, but no words, no verbal response.
Link to segment
Shanan Buckingham
Unverified
01:48:10
Unverified identity
Did you bring her to your ambulance?
Link to segment
Robert Costanzo
Unverified
01:48:11
Unverified identity
Yes, we did.
Link to segment
Shanan Buckingham
Unverified
01:48:13
Unverified identity
And when you got to the ambulance, what was your role?
Link to segment
Robert Costanzo
Unverified
01:48:18
Unverified identity
I was the tech in charge. So we did as much of an assessment as we could without removing her from the board to look for any further injuries. Other than the injuries that the Duxbury Fire Department had already found, we didn't find any further injuries. And then we continued with treatment, vital signs and such.
Link to segment
Shanan Buckingham
Unverified
01:48:38
Unverified identity
When you did the assessment, did you look at her head?
Link to segment
Robert Costanzo
Unverified
01:48:41
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
01:48:41
Unverified identity
Were there any cuts or bumps or dents that you noticed in her head?
Link to segment
Robert Costanzo
Unverified
01:48:44
Unverified identity
Not that we noticed, no.
Link to segment
Shanan Buckingham
Unverified
01:48:46
Unverified identity
What about her arms? Other than the bandaging on her wrist, were there any cuts, obvious broken bones or injuries to her arms or her hands?
Link to segment
Robert Costanzo
Unverified
01:48:56
Unverified identity
No obvious broken bones or anything, no.
Link to segment
Shanan Buckingham
Unverified
01:49:03

And you said you were the tech. What does that mean?
Link to segment
Robert Costanzo
Unverified
01:49:06
Unverified identity
I was the medic that was in charge. [inaudible 01:49:13] medic that's in charge or you're the medic in charge. So I was the medic in charge.

01:49:16

Link to segment

Link to segment

Link to segment
Robert Costanzo
Unverified
01:49:42

It's typically about, from Pembroke, it would be about 15 minutes, so it would be a little bit longer than that. I'm not sure of the exact time, so probably maybe 18 minutes.

Okay. And while you're in that transport in the back of the ambulance, after you've done this examination of Lindsay Clancy to see if there are any other injuries, what do you do next?

01:50:03

So we would start treatment. So we put in two IVs as a precaution and any other treatment that was needed. So we noticed that her pupils were constricted and she was unresponsive. So we treated for a potential opioid overdose. We gave two milligrams of Narcan and she seemed to become a little bit more agitated, reaching, trying to grab, reaching out with her arms, but no verbal communication. She never fully woke up.

And have you given Narcan to individuals in the past in your role as a paramedic?

Yes, I have.

What is the typical reaction when you give a patient Narcan?
Link to segment
Robert Costanzo
Unverified
01:50:49
Unverified identity
It depends on the drug that they took or the amount of drugs that they took, but depending on what they take, their respirations will go up, their pupils will get a little bigger. Sometimes they fully wake up.

And you were referring to patients that you've dealt with in the past in your role as a paramedic, is that correct?

01:51:11
Unverified identity
That's correct, yes.
Link to segment
Shanan Buckingham

Robert Costanzo
Unverified
01:51:16
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
01:51:18

And what type of drugs, based on your training experience, does Narcan work on?
Link to segment
Robert Costanzo
Unverified
01:51:24
Unverified identity
We're trained to use it for opioid overdoses. So heroin, fentanyl, other drugs like that.
Link to segment
Shanan Buckingham
Unverified
01:51:30
Unverified identity
Okay. And does Narcan typically work on benzodiazepine?
Link to segment
Robert Costanzo
Unverified
01:51:35

We are not trained to use it for anything other than opioids.
Link to segment
Shanan Buckingham

Okay. And when you gave Lindsay Clancy the Narcan, she did not wake up, correct?

Yeah, we don't give it for benzodiazepines.

Link to segment
Shanan Buckingham

And what about the cuts on her wrists?
Link to segment
Daniel Dougherty
Unverified

Link to segment
Shanan Buckingham

Correct.
Link to segment
Shanan Buckingham
Unverified
01:59:38
Unverified identity
Okay. And what, if anything, did you do to treat those wounds?
Link to segment
Daniel Dougherty
Unverified
01:59:41
Unverified identity
We bandaged them up. I believe we placed a ABD pad, just a sterile pad on her neck as well.
Link to segment
Shanan Buckingham
Unverified
01:59:47
Unverified identity
You said an APD or a sterile pad. Is that just a type of gauze or something that you put on the wound?
Link to segment
Daniel Dougherty
Unverified
01:59:55
Unverified identity
Yes. Yes.
Link to segment
Shanan Buckingham
Unverified
01:59:59
Unverified identity
Okay. And so you did that, and then you bandaged the wrist or vice versa?
Link to segment
Daniel Dougherty
Unverified
02:00:00
Unverified identity
It was the wrist first, I believe. But we did secure the airway first before bandaging her wrist.
Link to segment
Shanan Buckingham
Unverified
02:00:08
Unverified identity
Okay. So when you first arrived, is she breathing on her own?
Link to segment
Daniel Dougherty
Unverified
02:00:11

She was.
Link to segment
Shanan Buckingham
Unverified
02:00:12

Link to segment
Daniel Dougherty
Unverified
02:00:14

Somewhat.
Link to segment
Shanan Buckingham
Unverified
02:00:15
Unverified identity
And what does that mean?
Link to segment
Daniel Dougherty
Unverified
02:00:16
Unverified identity
Not totally responsive. Pretty much the painful stimuli.
Link to segment
Shanan Buckingham
Unverified
02:00:21
Unverified identity
And what is painful stimuli?
Link to segment
Daniel Dougherty
Unverified
02:00:23
Unverified identity
As we were moving her, she somewhat regained consciousness on us.
Link to segment
Shanan Buckingham
Unverified
02:00:27
Unverified identity
And painful stimuli, is that when someone reacts physically or verbally to pain?
Link to segment
Daniel Dougherty
Unverified
02:00:35
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:00:37
Unverified identity
And so you said that you assess her when you first get there, you said you did the airway first, is that right?
Link to segment
Daniel Dougherty
Unverified
02:00:43
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:00:43
Unverified identity

Link to segment
Daniel Dougherty
Unverified
02:00:45

02:00:50
Unverified identity
What's an OPA device?
Link to segment
Daniel Dougherty
Unverified
02:00:51
Unverified identity
It's a plastic device that depresses the tongue just to keep the airway open.
Link to segment
Shanan Buckingham
Unverified
02:00:56
Unverified identity
Okay. So it's not the tube that goes down?
Link to segment
Daniel Dougherty
Unverified
02:00:58
Unverified identity
No.
Link to segment
Shanan Buckingham
Unverified
02:00:58
Unverified identity
It's just something that holds the tongue down?
Link to segment
Daniel Dougherty
Unverified
02:00:59
Unverified identity
That's correct.
Link to segment
Shanan Buckingham
Unverified
02:01:00
Unverified identity
Okay. And after you did that, what was the next step?
Link to segment
Daniel Dougherty
Unverified
02:01:04
Unverified identity
We placed a non-rebreather air mask on her and set the oxygen.
Link to segment
Shanan Buckingham
Unverified
02:01:08
Unverified identity
So is that just a mask that goes on the face providing oxygen?
Link to segment
Daniel Dougherty
Unverified
02:01:11
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:01:12
Unverified identity
And then what did you do next?
Link to segment
Daniel Dougherty
Unverified
02:01:13
Unverified identity
From there, that's when we heard the scream.
Link to segment
Shanan Buckingham
Unverified
02:01:17
Unverified identity
And so did you bandage the neck and the wrist before securing the breathing or after?
Link to segment
Daniel Dougherty
Unverified
02:01:24
Unverified identity
That was after.
Link to segment
Shanan Buckingham
Unverified
02:01:25
Unverified identity
Okay. So just to be clear, first is securing the tongue down, putting the oxygen mask on, and then you did the bandaging?
Link to segment
Daniel Dougherty
Unverified
02:01:34
Unverified identity
That came later, yes.
Link to segment
Shanan Buckingham
Unverified
02:01:35
Unverified identity
Later. Okay. So was the bandaging before or after you heard the screams?
Link to segment
Daniel Dougherty
Unverified
02:01:39
Unverified identity
That was after.
Link to segment
Shanan Buckingham
Unverified
02:01:40
Unverified identity
Okay. So when you hear the screaming, what, if anything, do you do?
Link to segment
Daniel Dougherty
Unverified
02:01:45
Unverified identity
I looked at Captain Hussey and Firefighter Heath, and we all looked at each other trying to figure out what was going on.
Link to segment
Shanan Buckingham
Unverified
02:01:56
Unverified identity
Okay. And did any of you leave the area after hearing the screaming?
Link to segment
Daniel Dougherty
Unverified
02:01:59
Unverified identity
Captain Hussey did. Firefighter Heath went to go get a backboard for the patient.
Link to segment
Shanan Buckingham
Unverified
02:02:04
Unverified identity
Okay. And did you stay with Lindsay Clancy?
Link to segment
Daniel Dougherty
Unverified
02:02:06
Unverified identity
I did.
Link to segment
Shanan Buckingham
Unverified
02:02:06
Unverified identity
Okay. And then is it at that point that you do the bandaging or after you get the backboard?
Link to segment
Daniel Dougherty
Unverified
02:02:13
Unverified identity
Kevin was gone for a while, so that's when I started bandaging upper wrists.
Link to segment
Shanan Buckingham
Unverified
02:02:18
Unverified identity
Okay. And did he eventually return with the backboard?
Link to segment
Daniel Dougherty
Unverified
02:02:26
Unverified identity
He did not.
Link to segment
Shanan Buckingham
Unverified
02:02:27
Unverified identity
So you bandaged the wrist. What happens next?
Link to segment
Daniel Dougherty
Unverified
02:02:30
Unverified identity
I believe it was Officer Hall came to the backyard. He asked if I needed anything. I told him the board. Gave him a direction of where in the truck it was. And then he also left to go grab that for me.
Link to segment
Shanan Buckingham
Unverified
02:02:42
Unverified identity
And when you say the board, are you referring to the backboard?
Link to segment
Daniel Dougherty
Unverified
02:02:44
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:02:45
Unverified identity
And did he return with the backboard?
Link to segment
Daniel Dougherty
Unverified
02:02:47
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:02:48
Unverified identity
And was Ms. Clancy loaded onto the backboard?
Link to segment
Daniel Dougherty
Unverified
02:02:51
Unverified identity
She was.
Link to segment
Shanan Buckingham
Unverified
02:02:52
Unverified identity
And who assisted you with that?
Link to segment
Daniel Dougherty
Unverified
02:02:55
Unverified identity
It was Officer Hall, I believe, and our retired deputy.
Link to segment
Shanan Buckingham
Unverified
02:02:59
Unverified identity
And is there a process that you follow when placing someone onto a board to ensure that you don't cause further damage?
Link to segment
Daniel Dougherty
Unverified
02:03:06
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:03:07
Unverified identity
And what is that process?
Link to segment
Daniel Dougherty
Unverified
02:03:09
Unverified identity
Just see spine precautions. So you secure the neck and make sure that it's immobilized as you move the patient.
Link to segment
Shanan Buckingham
Unverified
02:03:16
Unverified identity
So what did you do to secure her neck?
Link to segment
Daniel Dougherty
Unverified
02:03:19
Unverified identity
We had someone at her neck, I don't remember who it was, just hold steady that her neck didn't move in the process.
Link to segment
Shanan Buckingham
Unverified
02:03:26
Unverified identity
Okay. And then did you follow that protocol, the C-spine protocol, to safely put her onto the backboard?
Link to segment
Daniel Dougherty
Unverified
02:03:31
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:03:32
Unverified identity
Okay. And at some point was a collar placed around her neck?
Link to segment
Daniel Dougherty
Unverified
02:03:34
Unverified identity
I believe so, yes.
Link to segment
Shanan Buckingham
Unverified
02:03:36
Unverified identity
And then what happened next?
Link to segment
Daniel Dougherty
Unverified
02:03:38
Unverified identity
I believe I got on the radio and asked our captain who was transporting first because we knew that there was multiple patients at that point.
Link to segment
Shanan Buckingham
Unverified
02:03:47
Unverified identity
Okay. And what were you told?
Link to segment
Daniel Dougherty
Unverified
02:03:50
Unverified identity
Pembroke was on its way in. They may have just arrived and she was going with Pembroke.
Link to segment
Shanan Buckingham
Unverified
02:03:56
Unverified identity
Okay. And were you part of the team that transported her from the backyard to the Pembroke ambulance?
Link to segment
Daniel Dougherty
Unverified
02:04:01
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:04:03
Unverified identity
And did you help load her into the Pembroke ambulance?
Link to segment
Daniel Dougherty
Unverified
02:04:05
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:04:07
Unverified identity
And did you go with them during that transport?
Link to segment
Daniel Dougherty
Unverified
02:04:09
Unverified identity
I did not.
Link to segment
Shanan Buckingham
Unverified
02:04:15
Unverified identity
Okay. After Ms. Clancy was loaded into the ambulance, did it leave?
Link to segment
Daniel Dougherty
Unverified
02:04:20
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:04:20
Unverified identity
What did you do next?
Link to segment
Daniel Dougherty
Unverified
02:04:21
Unverified identity
I went to our ambulance that was in the driveway at that point.
Link to segment
Shanan Buckingham
Unverified
02:04:26
Unverified identity
Okay. And was Dawson Clancy in that ambulance?
Link to segment
Daniel Dougherty
Unverified
02:04:28
Unverified identity
He was.
Link to segment
Shanan Buckingham
Unverified
02:04:29
Unverified identity
And did you ride in the ambulance to the hospital with Dawson Clancy?
Link to segment
Daniel Dougherty
Unverified
02:04:33
Unverified identity
I did.
Link to segment
Shanan Buckingham
Unverified
02:04:33
Unverified identity
What was your role in that ambulance?
Link to segment
Daniel Dougherty
Unverified
02:04:35
Unverified identity
I was operating the bag valve mask for him.
Link to segment
Shanan Buckingham
Unverified
02:04:38
Unverified identity
Okay. So you're trying to provide [inaudible 02:04:47].
Link to segment
Kevin Reddington
Unverified
02:04:58
Unverified identity
Are you an EMT, a paramedic or-
Link to segment
Daniel Dougherty
Unverified
02:05:01
Unverified identity
Paramedic.
Link to segment
Kevin Reddington
Unverified
02:05:01
Unverified identity
Paramedic. And how long do you study for that?
Link to segment
Daniel Dougherty
Unverified
02:05:06
Unverified identity
Two years plus.
Link to segment
Kevin Reddington
Unverified
02:05:08
Unverified identity
Would that be full-time studying or are you working at the same time?
Link to segment
Daniel Dougherty
Unverified
02:05:11
Unverified identity
I was working at the same time.
Link to segment
Kevin Reddington
Unverified
02:05:12
Unverified identity
Okay. Do you know on that evening what the temperature was outside?
Link to segment
Daniel Dougherty
Unverified
02:05:18
Unverified identity
It was cold.
Link to segment
Kevin Reddington
Unverified
02:05:19
Unverified identity
Wicked cold, wasn't it?
Link to segment
Daniel Dougherty
Unverified
02:05:20
Unverified identity
In the 30s.
Link to segment
Kevin Reddington
Unverified
02:05:20
Unverified identity
It was lower than that, wasn't it?
Link to segment
Daniel Dougherty
Unverified
02:05:21
Unverified identity
It was a couple-
Link to segment
Kevin Reddington
Unverified
02:05:23
Unverified identity
It was really cold.
Link to segment
Daniel Dougherty
Unverified
02:05:24
Unverified identity
Yeah.
Link to segment
Kevin Reddington
Unverified
02:05:25
Unverified identity
And how long was she laying in the snow and on the ground?
Link to segment
Daniel Dougherty
Unverified
02:05:29
Unverified identity
We got the call at six-ish or whatever time it was. We responded-
Link to segment
Kevin Reddington
Unverified
02:05:33
Unverified identity
And the call came because her husband came home from picking up food and found her on the ground, right?
Link to segment
Daniel Dougherty
Unverified
02:05:40
Unverified identity
Correct.
Link to segment
Kevin Reddington
Unverified
02:05:40
Unverified identity
So you don't know how long she was laying in the snow on the ground, right?
Link to segment
Daniel Dougherty
Unverified
02:05:44
Unverified identity
No.
Link to segment
Kevin Reddington
Unverified
02:05:45
Unverified identity
In the cold?
Link to segment
Daniel Dougherty
Unverified
02:05:46
Unverified identity
Correct.
Link to segment
Kevin Reddington
Unverified
02:05:46
Unverified identity
And what's hemostasis? Do you know?
Link to segment
Daniel Dougherty
Unverified
02:05:49
Unverified identity
What's that?
Link to segment
Kevin Reddington
Unverified
02:05:50
Unverified identity
What's hemostasis? What does that mean?
Link to segment
Daniel Dougherty
Unverified
02:05:52
Unverified identity
Just the coagulation.
Link to segment
Kevin Reddington
Unverified
02:05:54
Unverified identity
And do you know what the effect of hypothermia... Let me ask you, what's hypothermia?
Link to segment
Daniel Dougherty
Unverified
02:05:59
Unverified identity
It's just the body under temperature of the body.
Link to segment
Kevin Reddington
Unverified
02:06:03
Unverified identity
Under temperature of the body?
Link to segment
Daniel Dougherty
Unverified
02:06:04
Unverified identity
Or your body is not at temperature that it should be.
Link to segment
Kevin Reddington
Unverified
02:06:09
Unverified identity
Right. Because of the environment, right? Cold, right?
Link to segment
Daniel Dougherty
Unverified
02:06:13
Unverified identity
Yes.
Link to segment
Kevin Reddington
Unverified
02:06:13
Unverified identity
Sometimes it can be medically induced, right. Hypothermia affects the blood flow, doesn't it?
Link to segment
Daniel Dougherty
Unverified
02:06:19
Unverified identity
Yes.
Link to segment
Kevin Reddington
Unverified
02:06:20
Unverified identity
In fact, you actually have a thing called therapeutic hypothermia, right.
Link to segment
Daniel Dougherty
Unverified
02:06:25
Unverified identity
Mm-hmm.
Link to segment
Kevin Reddington
Unverified
02:06:26
Unverified identity
If they have to restrict the blood flow to either a heart or a brain or something that a person can be induced medically to be cold-
Link to segment
Daniel Dougherty
Unverified
02:06:33
Unverified identity
Yes.
Link to segment
Kevin Reddington
Unverified
02:06:34
Unverified identity
... and it would restrict blood flow, right.
Link to segment
Daniel Dougherty
Unverified
02:06:36
Unverified identity
Mm-hmm.
Link to segment
Kevin Reddington
Unverified
02:06:41
Unverified identity
So all these questions about whether or not there's blood seeping through the wrist bandages and whether or not there's blood through the holes from the neck brace, you don't know what effect the hypothermia, if any, had on that, would you?
Link to segment
Daniel Dougherty
Unverified
02:06:52
Unverified identity
No.
Link to segment
Kevin Reddington
Unverified
02:06:52
Unverified identity
Thank you, sir. That's all I have.
Link to segment
Judge William Sullivan
Unverified
02:06:52

Redirect?
Link to segment
Shanan Buckingham
Unverified
02:06:59
Unverified identity
Sir, there's typically heat in a hospital, correct?
Link to segment
Daniel Dougherty
Unverified
02:07:01
Unverified identity
Usually, yes.
Link to segment
Shanan Buckingham
Unverified
02:07:02
Unverified identity
And were you aware that Ms. Clancy went to South Shore Hospital, correct?
Link to segment
Daniel Dougherty
Unverified
02:07:07
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:07:08
Unverified identity
And are you aware that the wounds on her wrist did not have to be sutured until the following day?
Link to segment
Daniel Dougherty
Unverified
02:07:14
Unverified identity
I didn't get any of that information after.
Link to segment
Shanan Buckingham
Unverified
02:07:16
Unverified identity
Were you aware that the wound on her neck never had to be sutured?
Link to segment
Daniel Dougherty
Unverified

Link to segment
Shanan Buckingham
Unverified
02:08:48

I work at the Duxbury Police Department.
Link to segment

How long have you been with the Duxbury Police Department?
Link to segment

Unverified identity
About five and a half years.
Link to segment
Shanan Buckingham
Unverified
02:08:59

I want to direct your attention to January 24th, 2023. Were you working that day?
Link to segment
Vincent Cahill
Unverified
02:09:03
Unverified identity
Yes, ma'am.
Link to segment
Shanan Buckingham
Unverified
02:09:04

Were you on patrol?
Link to segment

Unverified
02:09:05

Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:06

And directing your attention further to approximately 6:11 PM, were you dispatched to 47 Summer Street in Duxbury?
Link to segment

02:09:15
Unverified identity
Yes, ma'am.
Link to segment
Shanan Buckingham
Unverified
02:09:18

How long did it take you to get there approximately?
Link to segment
Vincent Cahill
Unverified
02:09:21
Unverified identity
A couple minutes.
Link to segment
Shanan Buckingham
Unverified
02:09:22
Unverified identity
And when you arrived there, what did you see?
Link to segment
Vincent Cahill
Unverified
02:09:25
Unverified identity
When I arrived there, I saw a cruiser in the driveway, as well as an ambulance and a fire captain.
Link to segment
Shanan Buckingham
Unverified
02:09:32
Unverified identity
And did you head to the backyard?
Link to segment
Vincent Cahill
Unverified
02:09:34
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:35

Link to segment
Vincent Cahill
Unverified
02:09:38
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:39

And did you later learn that was Lindsay Clancy?
Link to segment
Vincent Cahill
Unverified
02:09:41
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:42
Unverified identity
At some point, do you hear, or did you hear, loud screaming?
Link to segment
Vincent Cahill
Unverified
02:09:46
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:47
Unverified identity
And as a result of that, did you go inside the home?
Link to segment
Vincent Cahill
Unverified
02:09:49
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:50
Unverified identity
And did you go to the basement area?
Link to segment
Vincent Cahill
Unverified
02:09:52
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:09:53
Unverified identity
And when you went down the basement stairs, did you go to the right or the left?
Link to segment
Vincent Cahill
Unverified
02:09:57
Unverified identity
I initially went to the right and I was following the father.
Link to segment
Shanan Buckingham
Unverified
02:10:01
Unverified identity
So as you're going down the stairs, you say the father, is that Patrick Clancy?
Link to segment
Vincent Cahill
Unverified
02:10:04
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:10:05
Unverified identity
Do you see him as you're going down the basement stairs?
Link to segment
Vincent Cahill
Unverified
02:10:07
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:10:08
Unverified identity
And where is he coming from and where is he going to?
Link to segment
Vincent Cahill
Unverified
02:10:10
Unverified identity
He's coming from my left, heading to my right.
Link to segment
Shanan Buckingham
Unverified
02:10:14
Unverified identity
And what is his demeanor?
Link to segment
Vincent Cahill
Unverified
02:10:16
Unverified identity
He was screaming.
Link to segment
Shanan Buckingham
Unverified
02:10:17
Unverified identity
And as you came down the stairs, did he point in a direction?
Link to segment
Vincent Cahill
Unverified
02:10:21
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:10:22
Unverified identity
Where did he point to?
Link to segment
Vincent Cahill
Unverified
02:10:23
Unverified identity
To the left side.
Link to segment
Shanan Buckingham
Unverified
02:10:23

And is that where you headed?
Link to segment
Vincent Cahill
Unverified
02:10:25
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:10:25
Unverified identity
And when you went to the left, did you see two children on the floor in that area of the basement?
Link to segment
Vincent Cahill
Unverified
02:10:30
Unverified identity
Yes.
Link to segment
Shanan Buckingham
Unverified
02:10:31
Unverified identity
And what did you do?
Link to segment
Vincent Cahill
Unverified
02:10:33
Unverified identity
I checked the pulse of the five-year-old girl and passed that information along. And then when fire came on scene, I then was backing away because fire was going to start taking over, taking care of the five-year-old girl. I then backed into the infant who was on the ground.
Link to segment
Shanan Buckingham
Unverified
02:10:50
Unverified identity
So you said that you checked the five-year-old, was that Cora Clancy?
Link to segment

Yes.

Sure. All right. Members of the jury, talking to counsel, there still is a couple of issues that we have to hammer out and get done. And rather than have you wait around, I'm not quite sure how long that's going to go, I'm going to excuse you for the day. All right? As I told you, sometimes the schedules don't always match up what I tell you they're going to do even a couple hours before. So I'm going to excuse you until tomorrow morning. All right? And so tomorrow morning, the plan is that we're going to go on this view. And I'll explain it a little bit more in detail tomorrow, but just so you can picture it in your head, I'm going to ask you to be here, to be ready to come out here at nine o'clock. I'm going to address you, probably ask you those same questions. Then I'll give you a little bit of information about the view. I'll give you an instruction. What the view is, we're going to go to a couple of areas. You're going to be able to get out and look at these areas. The lawyers will be there. They'll be able to point out what they feel is significant. And at that point, we'll then come back. We'll continue with some of the testimony. We may end up a little bit early tomorrow as well in regards to the schedules. And at that point, I'm going to talk to counsel, see where we are in regards to the overall schedule. But It's my impression that we are ahead of schedule at this point. So I just wanted to let you know that. So I'm going to excuse you till tomorrow morning rather than have you sit here and just wait in regards to that. So I'm going to excuse you till tomorrow. I'd ask you to be here at 9:00, check the weather, see, but you'll be on the view in the morning and then there'll be some witnesses in the afternoon. All right. So remember I'm going to ask you those questions. Don't read anything, don't talk about it, don't do any research, don't take any field trips, and I'll see you tomorrow morning. Okay? Thank you.

All right. In recess until tomorrow, the media the court had issued previously a specific order regarding the view. There was a supplemental order issued this morning, so everybody should just be aware of that. And I want to thank everybody for the consideration and that will be in recess until tomorrow morning.
